FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br />In Re: Variance Application 6-1984 <br />Raesta Estates <br /> <br /> This is a petition for a variance from the development standards in <br /> <br />particular requesting a variance from the size of Lots number 11, 12, 13, 14 and <br />22 in Raesta Estates in length and a variance requesting a 25 foot building line <br />as shown on plat for Lots number 23, 24, 25 and 26 and requesting a frontage of <br />78.14 feet instead of 120 feet on Lot number 22. The Mooresville Board of Zoning <br />Appeals having heard evidence on the above captioned petition now makes the following <br />findings of fact pursuant to Indiana Code 36-7-4-918.4: <br /> <br /> 1. That the approval of the petition will not be injurious to the <br /> <br /> public health, safety, morals, and general welfare of the community. <br /> More particularly the request made does not affect the adjoining <br /> property in that the deiations from the Mooresville Development <br /> Standards on the length of the lots are not significant and as <br /> to the building lines this concerns a property on a cul-de-sac <br /> which likewise gives his property additional frontage in excess <br /> of the 78.14 feet. <br /> <br /> 2. The use invalue of the area adjacent to the property included in <br /> the variance will not be affected in a substantially adverse manner <br /> due to the location and similar setbacks currently existing in the <br /> area. This is a proposed estate and the values of any of the <br /> surrounding lots which will be for sale do not seem to be adversly <br /> affected by the changes requested in the variance. <br /> <br /> 3. The strict application of the terms of the zoning ordinance will <br /> result in practical difficulties in the use of the property, in <br /> <br /> <br />
