FINDINGS OF FACT OF THE MOOPCESVILLE BOARD OF ZONING APPEALS <br /> <br />Re: <br /> <br />Mr. & Mrs. Thurmond Jacobs, 331 W. Main Street, Mooresville, <br />Indiana. This matter came before the Boar d of Zoning Appeals <br />on June 20, 1984 requesting a variance from the use and <br />development standards of the Civil Town of Mooresville. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br /> <br />above captioned petition now makes the following findings of fact pursuant to <br /> <br />I.C. 36-7-4-918.4: <br /> <br /> 1. That there are exceptional and extraordinary circumstances or conditions <br />applicable to the property of the petitioners and to the intended use that does not <br />apply generally to other property or class of use in the same vicinity and <br />in the district in which it is located. In particular that to have a double on <br />this property would provide a good buffer from general business and residential <br />zoning uses in the area. <br /> <br /> 2. That the variance is necessary for the preservation and enjoyment of <br /> <br />a substantial property right possessed by other property in the same vicinity <br />and district if such variance was not granted. In particular that to allow this <br />type of use would be a good compromise between the general business and residential <br />uses of property in this area. <br /> <br /> 3. That the granting of such variance will not be mutually detrimental <br /> <br /> to the public welfare or injurious to the property or improvements in the vicinity <br /> or district in which the subject property is located. In particular, that this <br /> use should be compatible to the surrounding areas and their present zoning and <br /> should not in any way affect the property. <br /> <br /> 4. That the granting of such variance will not alter the land use <br /> characteristics of the vicinity and the distrlct in which such property is located <br /> or diminish the marketable value of adjacent land and the improvements or cause <br /> or add to additional traffic congestion to the public streets in the area where <br /> the improvements are to be made in accordance with the granting of the variance. <br /> That this use should not increase traffic nor adversely affect property values. <br /> <br /> 5. That the Mooresville Board of Zoning Appeals, having heard evidence on <br /> the issuance of a variance and development standard to allow reduced front set- <br /> backs from 40 feet to 35 feet on Lots 9 and 10 and a side set-back from 60 feet <br /> to 32 feet now makes the following findings pursuant to Indiana Code: <br /> <br /> 1. That the approval of the petition will not be injurious to the <br /> public health, safety, morals and general welfare of the community. <br /> <br /> <br />
