FI~DIWGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEDiS <br /> <br />Re: <br /> <br />H. Hosten Bible and Elizabeth Ann Bible, 19 W. Main <br />Street. This is a petition for a variance from the <br />development standards in particular requesting a front <br />set-back of 0 from the development standmrds of 60 foot <br />and a side set-back of 0 Feet from the development standards <br />of 10 feet. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br /> <br />above captioned petition now makes the following findings of fact pursuant to <br /> <br />I.C. 36-7-4-918.4: <br /> <br /> 1. That there are exceptional and extraordinary circumstances or conditions <br />applicable to the property of the petitioners and to the intended use that does <br />not apply generally to other property or class of use in the same vicinity and <br />in the district in which it is located. In particular that the approval nf the <br />petition will not injurious to the public health, safety, morals and general <br />welfare of the community in that said request is made in the downtown area where <br />sa~d set-backs are currently in existence and this does not change the general <br />appearance or use of the surrounding areas nor create any public health, safety <br />or moral injury. <br /> <br /> 2. That the variance is necessary for the preservation and enjoyment of a <br /> substantial property right possessed by other property in the same vicinity and <br /> district if such variance was not granted. The use of the area adjacent to thc <br /> property included in the variance will not be affected in a substantial adverse <br /> manner as the character of the dow~tov~ buildings and structures are all similiar <br /> to said proposed use. <br /> <br /> 3. That the granting of such variance will not be materially detrimental <br /> <br /> to the public welfare or injurious to the property or ~mprovements in the vicinity <br /> or district in which the subject property is located.
