FINDINGS OF FACT <br /> <br /> A Petition for a Variance having been filed by Jay and Nila <br />Turley requesting a variance from the residential minimum square <br />footage requirement of 1100 feet to a home of 728 square feet on <br />real property located at 1691 Hadley Road, and currently zoned <br />agricultural. That the Board of Zoning Appeals having heard the <br />Petitioner and Remonstrators on Wednesday, September 16, 1992. <br />The Board of Zoning Appeals having heard the case of the <br />Petitioners and all Remonstrators now makes the following findings <br />of fact: <br /> <br /> 1. That the approval of the variance would not be injurious <br />to the public health, safety, morals, and general welfare of the <br />community in that the location of this property has a separate <br />well, septic system, and is replacing a cabin of comparable size <br />that had burned and there is sufficient ground in the area that <br />this property would not affect the adjoining homeowners. <br /> <br /> 2. That the use and value of the area adjacent to the <br /> property included in the variance would not be affected in any <br /> substantially adverse manner due to the amount of ground and <br /> proximity of this home to other uses. <br /> <br /> 3. That the strict application of the terms of the zoning <br /> <br />ordinance would result in practical <br />property due to the location of the <br />loss due to the fire. <br /> <br /> The Board now grants <br />requirements of the home <br /> <br />difficulties in the use of the <br />septic system and well and the <br /> <br />the variance as to the square footage <br />from 1100 square feet to 728 square feet. <br /> <br />MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> <br />
