MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> FINDINGS OF FACT <br /> <br />The Mooresville Board of Zoning Appeals having heard the <br /> <br />request for variance from the use standards of the Civil Town of <br /> <br />Mooresville's zoning ordinance filed by George Smith requesting a <br /> <br />variance from use on the property at 527 East County Line Road to <br /> <br />operate a temporary employee business known as Benefits Resources. <br />The Board of Zoning Appeals having heard the evidence of the <br />petitioner and remonstrators and being duly advised in the <br />premises proceeded to the findings of fact pursuant to I.C. 36-7- <br /> <br />4-918.4 as follows: <br /> <br />1. The Board found that the approval of the variance could <br />create potentially dangerous traffic problems in the <br />residential area due to the proximity of the traffic, a lack <br />of any type of traffic plan and appropriate parking. <br /> <br />2. That the use and value of the area adjacent to the <br />property included in the variance would not be affected in a <br />substantially adverse manner due to the current condition of <br />the property and any improvement being a benefit to adjoining <br />properties. <br /> <br />3. That the need of the variance did not arise from some <br />condition peculiar to the property involved, there being no <br />showing of any such condition. <br /> <br />4. That the strict application of the terms of the zoning <br />ordinance would not constitute an unnecessary hardship if <br />applied to the property for which the variance is sought in <br />that there are other uses for said property. <br /> <br />5.
