FINDINGS OF FACT OF THE MOORESVILLE BOARD OF ZONING APPEALS <br /> <br />RE: Petition of Joel A. Beebe and Bonnie K. Beebe <br /> 117 Church Street, Mooresville, Indiana <br /> <br /> This matter came before the Mooresville Board of Zoning Appeals on <br />September 19, 1984, at the regular scheduled meeting. The petition requested <br />a variance from the development standards in particular the 40 foot front line <br />setback and the 12 foot side yard setback requesting a front yard setback of <br />25 feet 8 inches and a side setback of 6 1/2 feet. <br /> <br /> The Mooresville Board of Zoning Appeals, having heard evidence on the <br />above captioned petition now makes the following findings of fact pursuant to <br />Indiana Code 36-7-4-918.5: <br /> <br /> 1. That the approval of this variance from the development standards <br />will not be injurious to the public health, safety, morals or general welfare <br />of the community. That in particular, the neighborhood has several other <br />residences with similar setbacks and the construction as proposed should in <br />no way have any affect on the general public health, safety, morals or general <br />welfare of the community. <br /> <br /> 2. That the use and value of the area adjacent to the property included <br />in the variance will not be affected in a substantially adverse manner. Due to <br />the construction in the neighborhood of many of the residences which are less <br />than the 12 foot side setback and 40 foot front yard setback, the proposed con- <br />struction should have no affect on the area adjacent to the property. <br /> <br /> 3. The strict application of the terms of the zoning ordinance will re- <br />sult in practical difficulties in the use of the property. In particular, the <br />property could not be expanded for any normal residential use and the setback <br />proposed would not be any different than the current front yard setback on the <br />existing structure which would prohibit any normal expansion of this facility if <br />the strict application of the terms of the zoning ordinance were applied. <br /> <br />~arren FranklY, Secretary <br />Dated: /z/X,~, ,:"n'~',~r"~:'/' <br /> <br />S~eve Oschman, Chairman <br /> <br /> <br />
