<br />, J~ <br />i '\ <br />~ <br /> <br />--- <br /> <br />. <br />" ...... ) <br /> <br />9918528 <br /> <br />BookjlLPagÅ¡l-' '12 <br /> <br />UTILITY EASEMENT <br /> <br />THIS INDENTURE, made this ...J..9_1:À- day of <br /> <br />October <br /> <br />, 1999 <br /> <br />by and between Molex Incorporated, a Delaware corporation, (hereinafter referred to as <br /> <br />"Grantor") and the Civil Town of MooresviIle (hereinafter referred to as "Grantee"), <br /> <br />WITNESSETH: <br /> <br />That the Grantor, in consideration of One Dollar ($1,00) and other valuable consideration <br /> <br />paid by Grantee, the receipt of which is hereby acknowledged, has granted and released and <br /> <br />does hereby grant and release to Grantee, its successors and assigns, a right-of-way easement <br /> <br />subject to any prior easement or right-of-way to install, inspect, repair, maintain, operate, <br /> <br />replace, extend, renew and change size of, and remove any prior underground sanitary sewer <br /> <br />lines, including manholes and such other appurtenants or supporting apparatus, structures or <br /> <br />markers as Grantee, or such assignees a Grantee may elect, may now or shall from time to time <br /> <br />hereinafter deem reasonably necessary for the transportation of sewage on, and under, and <br /> <br />through a strip of land described in the granted easement area more particularly set out in the <br /> <br />attached Exhibit "A". Said easement shall allow Grantee to cut roots or remove any trees, <br /> <br />shrubs or other obstructions within the easement herein described as shall be deemed reasonably <br /> <br />necessary to keep pipes and other appurtenant apparatus free from interference, together with <br /> <br />the non-exclusive right-of-way and easement for the passage of men, vehicles and machines for <br /> <br />all of the above purposes. Grantee shall conduct its operation in such a way as not to interfere <br /> <br />with the operation of Grantor's use of the property, Furthermore, Grantee covenants that it shall <br /> <br />make every effort to restore the easement area to the condition it was in prior to any work being <br /> <br />performed by Grantee on Grantor's property. <br /> <br />It being the understanding of the parties hereto that the easement above described and <br />
