ORDINANCE NO. .3 ,-/19)" BEFORE THE MOORESVILLE TOWN COUNCIL UPON THE APPLICATION OF: FRANK H. LOWRY AN ORDINANCE REZONING LAND WITHIN THE TOWN OF MOORESVILLE UPON THE APPLICATION OF FRANK H. LOWRY WHEREAS, a hearing was held the 23rd day of February, 1995 with notice given as required by ordinance upon the application of Frank H. Lowry, for rezoning of the following described land from its present classification of Agriculture to that of Planned Unit Development - Multi Family; WHEREAS, the Planning commission of the Town of Mooresville did recommend approval of said rezoning, pursuant to the procedu~~ and ordinance of the Town; and pursuant to I.C. 36-7-4-608; " NOW, THEREFORE, BE IT ORDAINED that the zçming classificat'iòn of Planned Unit Development - Multi Family shall hereafter apply, and the Zoning Ordinance of the Town of Mooresville is amended to show said zoning for the following described real estate located in ", t. the Town of Mooresville, Morgan County, Indiana. A part of the Northwest Quarter of Section 12, Township.~3 North, Range 1 East, Morgan County, Indiana, described as follows,: commencing at a stone which marks the northwest corner of the above captioned Northwest Quarter; thence, with the west line of said Northwest Quarter, South no degrees 31 minutes 16 seconds West (assumed bearing), 235.63 feet to a point in the county road (for reference, an iron spike was found North ~ degrees 48 minutes 24 seconds East, 0.26 feet); thence, Norr~ 85 degrees 48 minutes 24 seconds East, 165.20 feet to an ir~ pin in the county road and the POINT OF BEGINNING of th~ subdivision herein described; thence South no degrees :0-8 minutes 05 seconds West, 627.39 feet to an iron pin; thence., South 87 degrees 16 minutes 21 seconds West, 473.43 feet to an iron pin on the west right-of-way line for State Highway No. 67, Project No. F-293 (27), 1964; thence, with said west right-of-way line for the following five (5) courses; 1.) North 01 degrees 52 minutes 42 seconds west, 449.76 feet to an iron pin; 2.) North 28 degrees 50 minutes 45 seconds west, 108.61 feet to an iron pin; 3.) North 77 degrees 24 minutes 12 seconds West 76.22 feet to a right-of-way marker; 4. ) North 85 degrees 45 minutes 10 seconds West, 214.73 feet to a right-of-way marker; 5.) North no degrees 58 minutes 16 seconds West, 30.00 feet to an iron pion in the county road; thence, South 88 degrees 47 minutes 58 seconds west, 111.62 feet to the Point of Beginning and containing 6.133 acres, more or less, including that portion hereby dedicated to the public for roadway purposes.
