ORDINANCE NO. :3 - /rcrcJ' BEFORE THE MOORESVILLE TOWN COUNCIL UPON THE APPLICATION OF: FRANK H. LOWRY, LIMITED LIABILITY COMPANY AN ORDINANCE REZONING LAND WITHIN THE TOWN OF MOORESVILLE UPON THE APPLICATION OF FRANK H. LOWRY, LIMITED LIABILITY COMPANY WHEREAS, a hearing was held the 27th day of April, 1995 with notice given as required by ordinance upon the application of Frank H. Lowry, Limited Liability Company, for rezoning of the following described land from its present classification of Agriculture to that of R-I (A); WHEREAS, the Planning Commission of the Town of Mooresville did recommend approval of said rezoning, pursuant to the procedures and ordinance of the Town; and pursuant to I.C. 36-7-4-608; NOW, THEREFORE, BE IT ORDAINED that the zoning classification of R-1 (A) shall hereafter apply, and the zoning Ordinance of the Town of Mooresville is amended to show said zoning for the following described real estate located in the Town of Mooresville, Morgan County, Indiana. Part of the East Half of the Southeast Quarter of Section 33, Township 14 North, Range 1 East, Morgan County, Indiana, described as follows: Commencing at a stone found per the county records marking the northeast corner of the east half of the Southeast Quarter of Section 33; thence South no degrees 58 minutes 53 seconds East (assumed bearing) with the east line of Section 33, 660.02 feet to an iron pin and the POINT OF BEGINNING of the parcel herein described; thence continuing with said east line South no degrees 58 minutes 53 seconds East 1563.89 feet to an iron pin; thence South 88 degrees 26 minutes 06 seconds west 200.00 feet to an iron pin; thence North no degrees 58 minutes 54 seconds West 54.58 feet to an iron pin found; thence South 88 degrees 26 minutes 06 seconds West 515.76 feet to an iron pin found; thence South 01 degrees 27 minutes 18 seconds East 130.00 feet to an iron pin found; thence South 09 degrees 38 minutes 42 seconds West 367.16 feet to an iron pin found in the county road on the south line of Section 33; thence with the county road South 88 degrees 26 minutes 06 seconds West 560.05 feet to an iron pin found per the county records on the west line of the quarter-quarter; thence with the quarter- quarter line North 01 degrees 10 minutes 35 seconds West 2002.42 feet to an iron pin; thence North 88 degrees 33 minutes 43 seconds East 1349.24 feet to the point of beginning.
