<br />I <br /> <br />- <br /> <br />- <br /> <br />ORDINANCE NO. 2 1994 <br />AN ORDINANCE ESTABLISHING CONTRIBUTION <br />REQUIREMENTS FOR DEVELOPERS AND NEW USERS <br />OF THE TOWN OF MOORESVILLE SEWER SYSTEM <br /> <br />WHEREAS, the Town of Mooresville, Indiana (Town) operates a <br /> <br />municipal sewer system for the collection and disposition of sewage <br /> <br />from property in and about the Town and desires to extend such <br /> <br />service from time to time to persons and entities needful thereof; <br /> <br />and <br /> <br />WHEREAS, such extension of services to the extent economically <br /> <br />feasible will have a long range effect of benefiting all users of <br /> <br />the municipal sewage facility by maintaining lower rates through <br /> <br />more usage; and <br /> <br />WHEREAS, it is recognized that the present sewer customers of <br /> <br />the Town through past sewer service charges and assessments have <br /> <br />made substantial contributions to the existing facilities <br /> <br />should not be required to make further capital contributions to <br /> <br />and <br />/----- <br /> <br />thl <br /> <br />benefit of new customers who connect to the system; and <br /> <br />WHEREAS, no sewer collection facilities will be extended by <br /> <br />the Town unless and until such area requesting extension is annexed <br /> <br />to the Town or the inhabitants thereof have agreed not to <br /> <br />remonstrate against such annexation in the future. <br /> <br />WHEREAS, <br /> <br />this <br /> <br />ordinance <br /> <br />will <br /> <br />establish <br /> <br />trunk <br /> <br />sewer <br /> <br />availability costs, sewer connection costs, create the Sewerage <br /> <br />Collection Fund, and Plant Expansion and Improvement Fund and fix <br /> <br />initial equivalent user tables and connection costs for developed <br /> <br />and undeveloped acreage desiring sanitary sewer service from the <br /> <br />Town of Mooresville, Indiana. <br /> <br />NOW, THEREFORE, BE IT ORDAINED, by the Town Council of the <br />
