ORDINANCE NO. J - ]993 AN ORDINANCE RESTRICTING USE OF PUBLIC FIRE HYDRANTS WHEREAS, the Civil Town of Mooresville, pursuant to Indiana Code 36-]-32 has the authority to pass ordinances necessary to affect the operation of the local government and to provide for the health and safety of the citizens of the Civil Town of Mooresville; WHEREAS, the Civil Town of Mooresville has received a from the Hoosier Water Company, Inc. concerning the use of hydrants; BE IT HEREBY ORDERED AND ORDAINED as follows: ]. That the Civil Town of Mooresville shall restrict the use of any public fire hydrant, public fire hydrant being defined as any fire hydrant located on the right-of-way of the Civil Town of Mooresville, to representatives of the Mooresville Fire and Street Departments or the Hoosier Water Company employees, their engineers, or contractors. 2. That anyone desiring to use a public hydrant shall first contact the Mooresville Fire Department and request permission to have the fire department meet them to open the hydrant. In the event of an emergency, the Mooresville Police Dispatcher shall be contacted for a representative of the Mooresville Fire Department to be present to open the hydrant and the party using the water shall keep records on the amount used and turn the same into the Hoosier Water Company, Inc. or its successors and assigns. 3. In the event of non-emergency situations, the Mooresville Fire Department shall refer the request to the Hoosier Water Company to allow them to make arrangements for obtaining the water through the hydrant located at the Hoosier Water Company's main office in Mooresville. 4. That the penalty for violation of this ordinance shall be a fine of not less than $25.00 nor more than $],000 along wit}] any damages to the hydrant, cost of water, and any court costs. 5. That violations of this ordinance shall be cited into the Mooresville Town Court by the Mooresville Town Marshall's office request public
