"Yard Rubbish" shall include all trimmings from plants <br />and shrubs and all plants and shrubs dug up and discardcd with the <br />intention of removing the same from a yard or tree branches or <br /> <br />yard trimmings and leaves, <br /> <br />5. "Business" shall mean any firm, partnership, corporation, <br /> <br />association, company, or organization of any kind that disposes of <br /> <br />any type of waste by burning on its premises or at any other <br /> <br />location within its control. <br />6. "Waste" shall include garbage, refuse, yard rubbish, or <br /> <br />any other by-product of a business. <br /> <br />Sec. b: <br /> <br />It shall be unlawful for any "business" within the <br /> <br />corporate limits of the Civil Town of Mooresville, Indiana, to <br /> <br />have any open burning of waste that emits embers or other debris <br /> <br />into the air creating a health hazard or fire hazard. Any <br /> <br />business receiving notice of a violation of the ordinance under <br /> <br />this section shall be required to install an incinerator or other <br /> <br />burning device which would keep debris, embers and other fire <br /> <br />hazards out of the air. All such incinerator or burning devices <br /> <br />must have screens or grates to entrap the flammable material from <br /> <br />emitting therefrom. <br /> <br />Any "business" that violates the open burning <br /> <br />policy after receiving notice of the hazard set out above by the <br /> <br />Fire Chief for the Town of Mooresville shall be subject to the <br />fines and penalties set out in Section H of this ordinance, <br /> <br />Sec, c: <br /> <br />It shall be unlawful for any "person" to burn any <br /> <br />type of waste within the corporate limits of the Civil Town of <br />Mooresville that emits embers or other debris into the alr <br /> <br />creating a health hazard or fire hazard.
