'l / - 1986 BE IT ORDAINED by the Board of Trustees of the Civil Town of Mooresville, Indiana, by the acts of the General Assembly of the State of Indiana and more particularly, pursuant to Indiana Code 36-10-3-34, it is hereby ORDERED AND ORDAINED that: WHEREAS, a petition was filed by certain residents of the unincorporated area of Brown Township requesting that the Town of ~Iooresvílle extend its park and recreation services to that unincorporated area of Brown Township pursuant to Indiana Code 36-10-3-33 et seq; WHEREAS, a public hearing was held by the Mooresville Department of Parks and Recreation pursuant to Indiana Code 36-10-3-34 sections (a) (b); WHEREAS, the Mooresville Department of Parks and Recreation approved the petition by resolution and recommended to the Town Board of Trustees this ordinance set out in said petition, namely, to extend the park and recreation services of the Mooresville Department of Parks and Recreation to the unincorporated area of Brown Township to further develop the existing park facilities and to increase the existing Park Board to have an additional appointment from the unincorporated area of Brown Township, the same to be appointed pursuant to Indiana Code: BE IT HEREBY ORDERED AND ORDAINED that the Town Board of Trustees shall fix a date for a special election to be held within ninety (90) days from the date of the adoption of this ordinance for those persons who qualify to vote at a primary, general or municipal election and who live in the affected area, namely, the unincorporated area of Brown Township, to vote on the referendum ballot to (1) yeslfor the extenstion of park and recreation services (2) nolagainst the extension of park and recreation services, with notice of said special election to be given pursuant to special election publication in accordance with Indiana Code 5-3-1. The Board further ORDERS necessary sums of money to be appropriated to defray the cost of the ballots and to pay the expense of said election at the rates prescribed by general election statute, the same to be appropriated from the General Fund or by transfer from the operating budget of the park and recreation department. SECTION II. IT IS HEREBY ORDERED that if said referendum favors the extension of the park and recreation services to the unincorporated area of Brown Township that
