<br />I' <br /> <br />- <br /> <br />ORDINANCE NO. )Ö <br /> <br />1985 <br /> <br />SPECIAL ORDINANCE REZONING REAL -ESTATE IN MORGAN COUNTY, INDIANA <br /> <br />WHEREAS, the Mooresville Plan Commission held a public hearing with <br /> <br />reference to an application for rezoning filed by Hart N. Hasten and Mark <br /> <br />".i <br /> <br />Hasten (an'Indiana partnership), and <br /> <br />WHEREAS, the Mooresville Plan Commission having jurisdiction over the <br /> <br />subject real estate has recommended to the Board of Trustees of the Town of <br /> <br />Mooresville, Indiana that the application for rezoning as filed by said applicants <br /> <br />be rezoned from its present classification LB-Local Business to B-Multiple <br /> <br />Family Dwelling, and <br /> <br />WHEREAS, the Board of Trustees of the Town of Mooresville, Indiana now <br /> <br />accepts the recommendation of the Mooresville Plan Commission and the following <br /> <br />real estate located within the jurisdiction of the Mooresville Plan Commission is <br /> <br />hereby rezoned to zoning classification B~Multiple Family Dwelling. Such real <br /> <br />estate located in Morgan County', State of Indiana, is more particularly described <br /> <br />as follows, to-wit: <br /> <br />P.art of the Southwest Quarter of Section 36, Township 14 North, <br />Range 1 East, in Morgan County, Indiana, described as follows: <br /> <br />/ <br /> <br />Commencing at the Southwest corner of Lot Number One (l), Block <br />Sixty-four (64), in Moore's Fourth Addition to the Town of <br />Mooresvil1e; thence South 00 degrees 14 minutes West a distance of <br />211.0 feet; thence South 89 degrees 46 minutes East a distance of <br />15.0 feet to a point on the 50.0 foot right-of-way of Old State <br />Highway 67, now South Indiana Street; thence South 00 degrees 14 <br />minutes West on said right-of-way a distance of 118.1 feet; thence <br />South 89 degrees 46 minutes East on the South line of a 50.0,!oot <br />road a distance of 363.0 feet to the true place of beginning of <br />tract herein described; thence South 00 degrees 14 minutes West <br />parallel to the centerline of South Indiana Street a distance of <br />160.0 feet; thence South 89 degrees 46 minutes East parallel with <br />the North line of said Moore Street a distance of 212.0 feet; thence <br />South 00 degrees 14 minutes West a distance of 185.0 feet; thence <br />South 89 degrees 46 minutes East 155.0 feet to a point located 230.0 <br />feet North of the North line of Moore Street extended; thence South <br />00 degrees 14 minutes West 230.0 feet to the North line of Moore <br />Street extended; thence North 89 degrees 46 minutes West along the <br />North line of Moore Street, 155.0 feet; thence South 00 degrees 14 <br />minutes West 375.0 feet to the North line of a tract now owned by <br />Gray Brothers; thence South 89 degrees 46 minutes East on said North <br />line a distance of 84.2 feet to the Northwest right-of-way line of <br />State Highway 67; thence North 53 degrees 37 minutes 27 seconds East <br />on a chord distance of 350.32 feet to the West right-of-way line of <br />the Con-Rail Railroad; thence North 02 degrees 57 minutes 30 seconds <br />East along said right-of-way a distance of 577.07 feet; thence South <br />87 degrees 02 minutes 30 seconds East a distance of 22.0 feet; <br />thence North 02 degrees 57 minutes 30 seconds East a distance of <br />125.0 feet to the Southeast corner of a tract containing 1.19 acres. <br />now owned by the Standard Oil Company; run thence North 89 degrees <br />46 minutes West a distance of 160.0 feet; thence North 02 degrees 57 <br />minutes 30 seconds East parallel to said railroad right-of-way a <br />distance of 250.0 feet to a point located 100.0 feet Southerly of <br />the South line of said Addition; thence North 89 degrees 46 minutes <br />West parallel with the South line of said Addition a distance of <br />484.65 feet to a point that is 413.0 feet East of the centerline of <br />South Indiana Street; thence run South 00 degrees 14 minutes West a <br />distance of 209.10 feet to the Beginning Point; containing 9.7 <br />acres. more or less. <br /> <br />Subject to any legal aasements or rights-of-way, <br />
