ORDINANCE NO. 1-1984 AN ORDINANCE VACATING PART OF THE RIGHT-OF-WAY OF WEST SOUTH STREET, MOORESVILLE, INDIANA The Town Board of Trustees of the Civil Town of Mooresville now finds the following: That a petition to vacate part of a public right-of-way of West South Street in Mooresville, Indiana was filed December 30, 1983 by Joan Wilkins as administrator of the Estate of Crystal Carpenter, deceased. That pursuant to Indiana Code 36-7-3-12 proper notice was given and the petition was found to be properly filed. That in particular the following described real property was requested to be vacated due to the fact that said property was not being used as a public right-of-way but instead was being used as part of the residence at said location at 143 West South Street, the legal description being: A part of Lot No. I, Block 69 and Lot No.2, Block 70 in Moores's Fourth Addition to the Town of Mooresville. Beginning on the North line of Lot No.2, Block 70, 35.0 feet east of the Northwest corner of said Lot No.2, run thence easterly on said North line of said Lot No.2 and Lot No.1, Block 69 a distance of 105.00 feet; thence run north a distance of 20.0 feet; run thence westerly parallel to said North lines a distance of 105.0 feet; thence run southerly a distance of 20.0 feet to the place of beginning, containing 2100 square feet, or 0.048 of an acre, more or less. That the Town Board finds that said street is not now and has not been used by the public as a right of way for ingress or egress to any privately or publically owned lands and the respective land owners of said private residence have used this property for in excess of fifty (SO) years. That the current public way creates a cloud on the title of said real property belonging to the estate of Crystal Carpenter. NOW, THEREFORE, BE IT ORDAINED by the Town Board of Trustees of the Civil Town of Mooresville, Indiana that: That the following described real property which is a public right-of-way on ¡,est South Street in the Civil Town of Mooresville, Indiana be vacated to and in favor of the Estate of Crystal Carpenter: A part of Lot No.1, Block 69 and Lot No.2, Block 70 in }oore' s Fourth Addit ion to the Town of Mooresville.
