r ORDINANCE # ,c, l)iI TOWN OF MOORESVILLE, INDIANA AN ORDINANCE CALLING FOR THE EXECUTION OF A SUPPLEMENTAL INDENTURE TO THE MORTGAGE AND INDENTURE OF TRUST BETWEEN THE TOWN OF MOORESVILLE, INDIANA AND MERCHANTS NATIONAL BANK AND TRUST COMPANY OF INDIANAPOLIS DATED JULY I, 1973 WHEREAS, on July 1, 1973, the Town of Mooresville, Indiana entered into a Mortgage And Indenture Of Trust ("Trust Indenture") with Merchants National Bank and Trust Company of Indianapolis as Trustee concerning certain Economic Development First Mortgage Revenue Bonds Series 1973 (Nice-Pak Products, Inc.); and WHEREAS, Section 1202 of said Trust Indenture provides for the amendment of said Trust Indenture through the execution of a Supplemental Indenture; and WHEREAS, the Town Board of Mooresville, as Issuer under said Trust Indenture desires to amend said Trust Indenture pursuant to Section 1202; and WHEREAS, this Ordiance is passed for the purpose of notifying the Trustee under said Trust Indenture of Issuer's desire to enter into a Supplemental Indenture and to set forth the contents thereof. NOW, THEREFORE, be it ordained by the Town Board of the Town of Mooresville, Indiana as follows: I. The Town of Mooresville, Indiana, Issuer under the above described Trust Indenture requests that the Trustee thereunder enter into a Supplemental Indenture pursuant to Section 1202 thereof, for the following purposes: a. amending §301 of said Trust Indenture by deleting the last paragraph thereof and substituting the following: "Bonds shall be called for redemption by the Trustee as herein provided upon receipt by the Trustee of written notice from the President of the Town Board of the Issuer at least ten (10) days prior to the redemption date, requesting redemption
