ORDINANCE # {:- ,g8 TOWN OF MOORESVILLE, INDIANA AN ORDINANCE CALLING FOR THE EXECUTION OF AN AMENDMENT TO ECONOMIC DEVELOPMENT FIRST MORTGAGE REVENUE BONDS, SERIES 1973 (NICE-PAl< PRODUCTS, INC.) WHEREAS, on July 1, 1973, the Town of Mooresville, Indiana entered into a Mortgage And Indenture Of Trust ("Trust Indenture") with Merchants National Bank and Trust Company of Indianapolis as Trustee securing certain Economic Development First Mortgage Revenue Bonds Series 1973 (Nice-Pak Products, Inc.) ("Bonds"); and WHEREAS, said Trust Indenture was amended through the execu- tion of a Supplemental Indenture to provide for optional redemption on any date on or after July 2, 1978; and WHEREAS, the Town Board of Mooresville, as Issuer of said Bonds desires to amend the Bonds in accordance with said Supplemental Indenture; and WHEREAS, this Ordinance is passed for the purpose of notifying the Trustee under said Trust Indenture and the holder(s) of the Bonds of Issuer's desire to enter into an Amendment to the Bonds and to set forth the contents thereof. NOW, THEREFORE, be it ordained by the Town Board of the Town of Mooresville, Indiana as follows: I. The Town of Mooresville, Indiana, Issuer of the Bonds requests that the Trustee and bondholder(s) enter into an Amend- ment of Bond(s) for the purpose of amending the eighth paragraph of the Bonds to delete the words "on any interest payment date" and substitute therefore the following: "at any time"; and further, for the purpose of amending the ninth paragraph of the Bonds to delete the words "thirty days" where they appear in said paragraph and substitute therefore the words: "ten days.
