I{ 1980 ORDIANANCE ANNEXING CONTIGUOUS TERRITORY TO THE TOWN OF MOORESVILLE, MORGAN COUNTY, INDIANA ¡ I BE IT ORDAINED, by the Civil Town of Mooresville, Morgan County, Indiana, that -- WHEREAS, I . Mitchell E. Denny and Lois Denny, husband and J wife, the owners of the following described real estate, presented an oral request for the annexation of such real estate, by and through their representative, Delbert A. Hobson, at a regular sche- duled meeting of the Board of Trustees of the Civil Town of Moores- ville, Indiana, on the 15th day of January, 1980, and WHEREAS, such real estate owned by said individuals is presently receiving governmental and proprietary services, sub- stantially equivalent in standard and in scope to the governmental and proprietary services furnished by the Civil Town of Mooresville, Indiana, to the other areas presently incorporated within the Civil Town of Mooresville, Indiana, and Pursuant to the powers vested in the Board of Trustees of the Civil Town of Mooresville, Morgan County, Indiana, it is hereby ORDERED AND ORDAINED that the following tract of real estate owned by said individuals, is hereby annexed to the Civil Town of Mooresville, Morgan County, Indiana, with a stipulation agreement by and between said parties (the Board of Trustees of the Civil Town of Mooresville, Indiana and said property owners), that the Board of Trustees shall not have the obligation to provide further municipal sewage facilities to said property, other than those pre- sently being provided to the existing improvements thereon, but may make available to said owners, municipal sewage utility service to the remaining part of said real estate which is not presently served by the Town's municipal sewage facilities, conditioned how- ever, that the present owners, their heirs or assigns of such tract L
