MOORESVILLE BOARD OF ZONING APPEALS <br /> <br /> The Board of Zoning Appeals for the Civil Town of Mooresville <br />met at a called meeting on Tuesday, October 24, 1978, at 7:30 P.M. <br />The following Board members were present: Mr. Steve Edwards; Mrs. <br />Nan Kollmeyer; Mr. Warren Franklin; and Mr. Paul Walters. The <br />attorney for the Board, Mr. David E. Lawson, was also present. <br /> <br /> Steve Edwards, as Chairman of the Commission, called the <br />meeting to order. In the absence of an appointed secretary, Mrs. <br />Nan Kollmeyer was again selected to act as acting secretary for the <br />meeting. <br /> <br />The minutes of the past meeting were read and approved. <br /> <br /> Mr. Edwards advised the Board that the meeting was called <br />to act upon four petitions which had been filed. <br /> <br /> Mr. Lawson, as attorney for the Board, indicated that all <br />petitions to be heard at this meeting were procedurally in order. <br />There were no third parties appearing either in favor of or against <br />the four petitions which were acted upon by the Board. <br /> <br /> The Board then proceeded to hear evidence on Petition #4-1978 <br />filed by Jack and Louellia Carver, of 699 Rose Lane. Mr. Carver <br />presented his position in his request for the variance and upon a <br />motion duly made by Mr. Paul Walters, seconded by Mr. Warren Franklin, <br />the Board unanimously approved the variance, wherein Mr. Carver was <br />permitted to proceed with the construction of an attached garage to <br />his existing residence, wherein the set back of the garage will only <br />be three feet seven inches from his property line, rather than seven <br />feet as called for by the existing zoning regulations. <br /> <br /> The next petition to be heard was that of Citizens Bank of <br />Mooresville, Indiana, which was Docket #5-1978. The bank was repre- <br />sented by its attorney, Mr. John Mills. Mr. Aron Gibbs, a Director <br />of the bank, also appeared. <br /> <br /> The request by the petitioner was for a variance in the <br />minimum rear yard. The bank desires to extend its existing facilities <br />to the north in such a manner that the minimum rear yard in feet <br />could not be adhered to. Upon motion duly made by Mr. Paul Walters <br />and seconded by Mr. Warren Franklin and unanimously passed, petitioner <br />was granted a variance to proceed with the construction of said build- <br />ing, wherein the building could be extended to a point 12 feet back <br />from the south of the existing sidewalk on the north side of the exist- <br />ing structure. <br /> <br /> The Board then proceeded to act upon Petition #6-1978 as filed <br />by Eugene D. and Barbara J. Perry. Petitioners were represented by <br />their attorney, Mr. John Mills. The request by the petition was for <br /> <br /> <br />
