ORDINANCE , 2016 <br />AN ORDINANCE REZONING LAND WITH THE <br />JURISDICTION OF THE TOWN OF MOORESVILLE, INDIANA <br />BEFORE THE TOWN COUNCIL OF MOORESVILLE, INDIANA <br />UPON THE APPLICATION OF: Bernard J. Lyons <br />WHEREAS, a public hearing was held the 10th day of December, <br />2015, with notice given as required by the Town Zoning Ordinance <br />upon the Application of Bernard J. Lyons for the rezoning of the <br />real property described on the attached Exhibit "A"; <br />WHEREAS, pursuant to IC 36-7-4 the Mooresville Plan <br />Commission has certified a favorable recommendation to the <br />Mooresville Town Council for the rezoning request from A-1 <br />Agricultural District to B-3 Business District with the <br />restriction that the only B-3 Use allowable will be an <br />excavation business and no other B-3 Uses; and, <br />WHEREAS, the Mooresville Town Council, after diligent <br />review of the matters pertaining to rezoning of the above- <br />described real property at a public meeting held on the 10th day <br />of December, 2015 find that the requested zoning classification <br />is appropriate. <br />NOW, THEREFORE, BE IT ORDAINED that the zoning <br />classification of B-3 Business District shall hereinafter apply <br />to the above-described real property and the Zoning Ordinance of <br />Mooresville, Indiana shall be amended to show and reflect said <br />
