MOORESVILLE BOARD OF ZONING APPEALS <br />FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br />Pursuant to IC 36-7-4-918.5, the Mooresville Board of Zoning <br />Appeals having heard the variance filed by Bob Jones, Pamela <br />Albertson and Angela Moore at the meeting held September 14, <br />2017, regarding Lots 43, parcel #55-01-25-459-003.000-005 and Lot <br />44, parcel #55-01-25-459-002.000-005, commonly known as 213 St. <br />Clair St., Mooresville, Indiana requesting a variance for the <br />construction of a two-family residence on a lot less than 10,000 <br />square feet from the side setbacks from 10' to 5'. <br />1. The approval will not be injurious to the public <br />health, safety, morals and general welfare of the community for <br />the following reasons: similar uses and setbacks within the area. <br />2. The use and value of the area adjacent to the property <br />included in the variance will not be affected in a substantially <br />adverse manner for the following reasons: these properties adjoin <br />one another with Lot 45 also being taken out of the development <br />standard variance. The general consequence of these variances <br />should not have any substantial adverse impact to the area which <br />is an old area of town with new development creating better <br />property values. <br />3. The strict application of the terms of the Zoning <br />ordinance will result in practical difficulties in the use of the <br />property, namely: the practical difficulties would include a <br />restricted use of these properties never being invested in due to <br />the area and other similar uses. The use as a double would <br />increase the ability to build on this property and make it viable. <br />
