Mooresville Planning Commission, February 11, 2021 <br />Schofield opposed, but the motion carried with the remaining votes of the Planning Commission. Mike Young <br />stated out loud for the public in attendance that the rezoning petition would be reviewed by the Town Council on <br />March 2"a <br />John Larrison of Holloway Engineering then presented a replatting of a primary plat on East Orchard Road on <br />behalf of Dennis and Nina Saner. He stated that the primary plat was zoned agricultural and in the buffer zone <br />across from Countryview Estates. The new platting will be a family compound minor plat with two lots. Lott <br />will be 3.2 acres for a new home and Lot2 is an existing home for the current owners. Lot 2 sits on a ridge <br />running through that area. This is an area of similarly large lots from 1+ to 5 acres. Plan for development is <br />representative of the way lots have been developed — rural residential. Primary septic field is on Lotl . Minimum <br />lot size for septic field has been met. Mike young called for public questions or comments. Mary Burge of 4950 <br />east Daisy Lane stated that the proposed lot was right in the back of her house and the reason they were interested <br />is that they just bought their dream home for retirement. She stated that she and her family were concerned about <br />drainage as Orchard Road is lower than the majority of the property. She asked Mr. Larrison what type of <br />development and housing would be developed, and how it would affect neighboring property values. Tom Hicks <br />of 10448 North Pennington Road stated he had the same concerns about the type of housing to be developed, <br />stating that neighboring homes were "pretty decent homes". Roy Burge of 4950 East Daisy Lane restated the <br />answer given to his wife that they would be two single family homes, but wanted to know how large and what <br />value. He stated that the homes in his subdivision were selling for $285,000 to $290,000, all brick, underground <br />wiring with a dedicated sewer system. He hears gunshots going off all the time to the north, and wants "to know <br />if what's coming is taking into account our homes?" Kimberly Schofield asked Mr. Larrison directly if the <br />property owners had plans for the type of homes to be developed. Mr. Larrison did not answer the question <br />directly, but made numerous statements regarding standards in the zoning ordinance, agricultural drainage, and <br />how everyone blames and/or attacks the "big bad developers". Mark Taylor asked the clarifying question "Can <br />you eliminate manufactured housing being put on this site?" Again, Mr. Larrison did not answer the question, he <br />stated that the land is zoned agricultural and construction will meet the standards of the UDO. Fle stated both <br />owners are professionals, and one sits on the School Board. He then angrily stated "We don't sit here to have <br />neighbors come in and ask what you're building". Perry King replied to Mrs. Burge's question regarding <br />drainage, saying the County controls drainage in the Buffer Zone. Mary Herold asked to speak and told Mrs. <br />Burge that primary drainage for that land was on the west side of the property into a deep ditch on Pennington <br />Road. Mark Taylor asked if the rezoning were granted tonight world it go to the town Council and was answered <br />"no" by numerous members of the Planning Commission. Mark Taylor then asked if approved, will the Planning <br />Commission be able to control what type of housing goes in. Mrs. Burge asked it a trailer park could be put on <br />the land, as members of her subdivision had fought the expansion of a manufactured homes development to the <br />north of their properties represented by the same engineering firm, Ross Holloway Engineering, as the Saner <br />property. Beth Copeland, Legal Counsel replied no, that the ordinance stated that it could be a single-family <br />home, farm stead or single manufactured home. Mike Young called for a motion and Robert Allenbaugh <br />motioned to approve, Jeff Deiterlen seconded, and the motion passed with Kimberly Schofield being the only <br />"nea" vote. <br />Mike Young called for new business, then old business, and receiving no response, called for a motion to adjourn. <br />JD Robinson so motioned, Josh Brown seconded and the meeting closed with a unanimous vote. <br />
