("Petitioner") petitioned the Town of Mooresville("Town") to rezone certain Real Estate with <br />the Parcel Identification Number of 55-02-28-235-001.000-015 more particularly described as <br />Outlot 1 in The Settlement at Heartland Crossing, Section I, a subdivision in Madison Township, <br />as per plat thereof recorded in Deed Record 400 Page 332, in the Office of the Recorder of Morgan <br />County, Indiana ("Subject Property").; and <br />WHEREAS, the Subject Property is located within the corporate boundaries of the Town <br />and the Town has jurisdiction over the zoning and use of the Subject Property; and <br />WHEREAS, Petitioner requested a change in zoning for the Subject Property from PDD- <br />R to B-1; and <br />WHEREAS, pursuant to Ind. Code 36-7-4 et seq, the Mooresville Plan Commission ("Plan <br />Commission") held a public hearing on or about the 13d' day of February, 2020 and made a <br />favorable recommendation to rezone the Subject Property from PUD -R to B-1 with the condition <br />that it would be limited to church uses only; and <br />WHEREAS, the Mooresville Town Council ("Town Council") held a public hearing on or <br />about the 3`d day of March, 2020 to consider the recommendation of the Plan Commission; and <br />WHEREAS, no remonstrances, written or oral, were made or provided in regards to the <br />rezoning of the Subject Property; and <br />WHEREAS upon consideration of the recommendation of the Plan Commission and <br />evidence provided, the Town Council accepts the recommendation of the Plan Commission. <br />NOW, THEREFORE, BE ORDAINED that the Subject Property shall be rezoned to a B- <br />1 classification with the condition that the Subject Property shall be limited to church uses only; <br />and <br />BE IT FURTHER ORDAINED that the Zoning Ordinance of the Town shall be amended <br />to reflect said amendment for the Subject Property and shall be in full force and effect upon the <br />passage of this Ordinance. <br />26448762.1 <br />
