MOORESVILLE TOWN COUNCIL <br />ORDINANCE NO. 6-2020 <br />ORDINANCE REZONING CERTAIN PROPERTY <br />WITHIN THE TOWN OF MOORESVILLE <br />WHEREAS, on or about the 21' day of February, 2020, the Szalay Masonry, LLC <br />("Petitioner") petitioned the Town of Mooresville("Town") to rezone certain Real Estate with the <br />Parcel Identification Number of 55-05-12-390-006-000.004 more commonly known as 10015 N <br />Old SR 67, Mooresville, Indiana ("Subject Property").; and <br />WHEREAS, the Subject Property is located within the corporate boundaries of the Town <br />and the Town has jurisdiction over the zoning and use of the Subject Property; and <br />WHEREAS, Petitioner requested a change in zoning for the Subject Property from AG to <br />I-1; and <br />WHEREAS, pursuant to Ind. Code 36-7-4 et seq, the Mooresville Plan Commission ("Plan <br />Commission") held a public hearing on or about the 13th day of February, 2020 and made a <br />favorable recommendation to rezone the Subject Property from PUD -R to B-1 with -the condition <br />that it would be limited to church uses only; and <br />WHEREAS, the Mooresville Town Council ("Town Council') held a public hearing on or <br />about the 12s' day of March, 2020 to consider the recommendation of the Plan Commission; and <br />WHEREAS, no remonstrances, written or oral, were made or provided in regards to the <br />rezoning of the Subject Property; and <br />WHEREAS upon consideration of the recommendation of the Plan Commission and <br />evidence provided, the Town Council accepts the recommendation of the Plan Commission. <br />NOW, THEREFORE, BE ORDAINED that the Subject Property shall be rezoned to an I - <br />classification; and <br />BE IT FURTHER ORDAINED that the Zoning Ordinance of the Town shall be amended <br />to reflect said amendment for the Subject Property and shall be in full force and effect upon the <br />passage of this Ordinance. <br />26448762.1 <br />�OC-�l�V3uz �v <br />202004397 ORD $25.00 <br />04/24/2020 10:13:168 2 PGS <br />ana K Gray <br />Morgan County Recorder IN <br />ecorded as Presented <br />VIII IIII I III VIII VIII VIII VIII VIII VIII VIII VIII VIII IIII IIII <br />
