Jessup Farms, Inc. and Susan Maddox Rezoning WHEREAS, this rezoning was requested by Susan C. Jessup Farms, Inc. and Susan Maddox and includes the consent of all owners of the subject property; and WHEREAS, the Town of Mooresville Plan Commission, pursuant to Indiana Code 37-7-4 did, on April 8, 2021 hod a legally advertised public hearing on said request and has certified an unfavorable recommendation to the Town Council of Town of Mooresville; and WHEREAS, the Mooresville Town Council, after diligent review of the matters pertaining to rezoning of the above described land at a public hearing held on the 18th day of May, 2021 find that the requested zoning classification, with voluntary commitments, is appropriate. NOWTHEREFORE BEITORDAINED bythe Town Council of the Town of Mooresville, Indiana as follows: SECTION 1: Official Zoning Map Thezoning classification of the real estate as described in Exhibit'A' which is within the zoning jurisdiction of Town of Mooresville, Indiana, shall be changed from Planned Unit Development— Residential (PUD -R) to Single -Family Residential (R1 c) with voluntary commitments per attached Exhibit 'B' SECTION 2: Commitment(s) Voluntary commitments per Indiana Code 36-7-4-1015 and as shown in attached Exhibit'B' shall run with the land and be binding upon owners, their heirs, successors and assigns. SECTION 3: Repealer All ordinances or parts thereof in conflict with this ordinance shall be repealed to the extent of such conflict.
