January 31, 2023 <br />The Mooresville Town Council met in a special session on Tuesday, January 31, 2023 at 6:30 P. M. at <br />the Mooresville Government Center. <br />Council members present were Council President Tom Warthen, Councilman Shane Williams, <br />Councilman Jeff Cook, Councilman Greg Swinney and Councilman Josh Brown. Attorney Chou-il <br />Lee was also present. <br />Council President Warthen gave the invocation and the special called meeting to order. <br />New Business— <br />Super Voluntary Annexation Public Hearing - Council President Warthen went over the 1999 rezoning <br />and the restrictions and covenants that were agreed to at that time for the rezoning to be <br />approved. Those restrictions include but are not limited to pollution, buffer zones, the ability to be <br />mined, and environmental impact. He touched on the loss of control of the non -jurisdictional buffer <br />zone as the County has taken control of those things, which is part of why the voluntary annexation has <br />been requested. He also highlighted a few of the positive benefits that have come with other industrial <br />developments. <br />Attorney Lee reiterated that this hearing is for any concerns or questions to be asked by the public but <br />that the ordinance will not be voted on tonight. <br />Jeff Loveless came before the council to ask if it is possible to get a copy of the covenants that were <br />agreed to in 1999. His concerns are the development of railroad spurs, pollution aspects, the impact on <br />the water table, noise, light, and hours of operation, and that he would prefer the facility not to be a 24- <br />hour facility. He's also concerned about the timeline and how quickly this could be approved, as some <br />neighbors have not obtained their certified letter. <br />Attorney Chou-il Lee explained that the timeline is set forth by the legislature and must take place on <br />the timeline set forth. He gave another brief overview of some of the buffer zone requirements, and the <br />special restrictions and covenants that were agreed to. The Plan Commission would have to be <br />consulted before any of the restrictions could be changed. <br />Jeff Loveless mentioned a facility on old 67, and he wants to ensure that whatever goes in there will <br />have favorable ascetics so as not to bring down home values. He is concerned about chemicals would be <br />stored. <br />Mike Dellinger stated that this hearing is not about the end user, but about whether the annexation is <br />the highest and best use of the property. He reiterated that the Planning Commission will be the ones to <br />look over and approve the final site plans. <br />Jeff Loveless asked for a larger copy of the plans that were sent in the letter. Councilman Swinney made <br />the motion to close the public hearing. Councilman Brown seconded. Motion carried 5-0 <br />Councilman Cook brought to light some IT issues that need to be addressed immediately. Seth Wells <br />with Telemagen informed the council that the current 2016 office software is incompatible with office <br />365 being used. They recommended updating the application licenses to enable the email functionality <br />to return and keep the software up to date. 2016 would need to be removed from desktops and the 365 <br />applications be installed. It would not affect the current documents or emails. Microsoft is phasing out <br />the compatibility of Office 2016. The software updates are included with the <br />license upgrade. The license upgrades will be $24.50 per month per seat and there are 120 seats <br />currently being used. There is no foolproof plan to prevent phishing, as it is primarily the end user's <br />responsibility to verify any links that may have been sent to them. While the One drive cloud is a <br />feature, it is not required to be used. Office 365 is the most up-to-date software and is continuously <br />updated. This should cut down on service calls about the inability to access email and <br />several other issues that have been occurring. Multi -factor identification is supported but optional as <br />several logistical concerns exist. There were also some additional concerns about the server room at the <br />
