INDIANA, REZONING THE SUBJECT PROPERTY FROM SINGLE -FAMILY <br />RESIDENTIAL (R-1) TO HIGH DENSITY RESIDENTIAL (R3) <br />WHEREAS, this rezoningwas requested byALtan Group, LLC, dated May 24, 2024, <br />being the owner of the subject property(41 W. High Street) and giving consent; and <br />WHEREAS, the Town of Mooresville Plan Commission, pursuant to Indiana Code <br />37-7-4 did, July 11, 2024, hold a Legally advertised public hearing on said request and has <br />certified a favorable recommendation to the Town Council of Town of Mooresville; and <br />WHEREAS, the Mooresville Town Council, after diligent review of the matters <br />pertaining to rezoning of the above described land at a public hearing held on the 6th day of <br />August, 2024, find that the requested zoning classification is appropriate. <br />NOW THEREFORE BE IT ORDAINED by the Town Council of the Town of Mooresville, <br />Indiana as follows: <br />SECTION 1: Official Zoning Map <br />The zoning classification of the real estate as described in Exhibit "A" which is within the <br />zoning jurisdiction of Town of Mooresville, Indiana, shall be changed from Single -Family <br />Residential (R-1) to High Density Residential (R3) <br />SECTION 2: Repealer <br />ALI ordinances or parts thereof in conflict with this ordinance shalt be repealed to the extent <br />of such conflict. <br />SECTION 3: Severability <br />If any provision, or the application of any provision, of this ordinance is held <br />unconstitutional or invalid the remainder of the ordinance, or the application of such <br />provision to other circumstances, shalt be unaffected. <br />SECTION 4: Effective Date <br />That this rezoning, shalt be effective as the execution of this Ordinance. <br />
