MOORESVILI_E BOARD OF ZONING APPEALS <br /> December 15,1999 <br /> <br />Tile Mooresville Board ofzotfing Appeals met for their re~lar meeting, the third <br />Wednesday of the month which xvas December 15,1999. The meeting was held at <br />the Mooresville Town Hall 26 South Indiana Street Members present were Donald <br />Brady, Alan Kran~er, Mike Young and Jeff Justus. Tim Cturens Town attorney was <br />also present. <br /> <br />The first item on tile agenda was the reading_ of the minutes from the November 17, <br />1999. Alan I~'amer motioned to approve the minutes, with the correction of the <br />spelling of negotiable in the sixth paragraph The second came from JeffJus'tus, the <br />motion carried 4-0 with none opposed. <br /> <br />Colleen Leffier came to the Board asking for a variance to have a Photography Studio <br />at 10 Circle Drive. Ms. Leffiet stated the her business wonld be by appointment only, <br />so that additional traffic would not be a problem. Nancy Slinger a friend and past <br />neighbor of3,Ls. Leffier's spoke in bls. Leffiers behave, saying that she had lived <br />across from the Leffiers for five years and the Studio had posed no problem with ~a.ffic <br />or properly value. Ms. Slinger also said that Ms Leffier had been active in the Crime <br />Watch program. MsSli~er is also a Realtor in Indianapolis. Kirk Witte orS1 Circle <br />Drive spoke for himself and other neighbors on Circle Drive with a signed document <br />saying that they were opposed to having a business in the residential area of Circle <br />Drive. Ma' Witte had 12 signatm'es out of the 16 residents of Circle Drive. He also <br />a copy of the deed. He drear attention to p~e 1 nmuber 4 xvhich states that without <br />secmmg written pernfission from at least 75o/o of the prope/ly owners that a business <br />should not be approved.( This was his interpretation of the deed). He spoke ofproperg' <br />values and a framer variance that xvas tinned down about 10 years ago. He said that this <br />is a uice quite neighbor hood and they wonld like it to stay as it is. ~. Morrison of 60 <br />Circle Drive also spoke against file variance and also spoke of the deed. Mx. Ctm'ens <br />explained that file Board was not bound by the covenant of the deed. Ms. stated that <br />she was selling a setx4ce only not retail, with on frutiger remarks from the Board or <br />the floor Mr Barry read the Developmental Standards. Alter the reading Mike Young <br />motioned to reject variance based on the second finding., JeffJm~tus seconded the motion <br />to r{iect the variance, the va~ lance was rejected 3-0 with Alan Kran~er did not voting. <br /> <br />With no further busiuess betYre the board motion was made by Alan Kramer to adjourn rile <br />meetiug, motion seconded by Mike Young, motion to adjourn passed 4-0 with none opposed. <br /> <br />Tile nexl meeting of the Mooresville Board Zoning Appeals will be held Januat3, 19,1999. <br /> <br /> <br />
