MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br /> <br /> Pursuant to IC 36-7-4-918.5 the Mooresville Board of Zoning Appeals having heard <br />the variance filed by Casey's Enterprises, LLC., on the location 239 Indianapolis Rd., <br />Section 36, Township 14 North, Range 1 East, recorded in Plat Book 391, Page 88, <br />requesting a variance from development standards of a 30' pylon ground sign from the <br />required 30' set back from both property lines and also for the erection of all signs and two <br />(2) additional side logos on the building and a pylon sign on the property which is in excess <br />of the total square footage required square footage an additional 41.86 square feet from the <br />required 136 square feet of the Ordinance; the Board now makes the following Finding of <br />Fact pursuant to IC 36-7-4-918.5: <br /> <br /> 1. The approval will not be injurious to the public health, safety, morals, and general <br />welfare of the community for the following reasons: that this is a B-3 use and consistent <br />with similar uses in the area. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance <br />will not be affected in a substantially adverse manner; for the reasons that: this is a B-3 use <br />consistent with similar uses in the area. <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance will result in practical <br />difficulties in the use of the property. However, the Zoning Ordinance may establish a <br />stricter standard than the "practical difficulties" standard prescribed by this subdivision. The <br />actual practical difficulties found to exist here are as follows: this is a comer lot and due to <br />the location requires signage on both sides and additional space to conduct its business none <br />of which is inconsistent with the Comprehensive Plan. <br /> <br />Stipulations to run with variance <br /> <br />None <br /> APPROVED ~.~] b~c~~i <br /> <br />Veto Kimmel <br /> <br />Brent Plunkett <br /> <br /> <br />
