MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br /> <br /> Pursuant to IC 36-7-4-918.5 the Mooresville Board of Zoning Appeals having heard <br />the variance filed by Mooresville Liquors (Larry and Kathy Lester), 335 S. Indiana St., <br />Mooresville, Indiana, requesting a variance to set back sign; the Board now makes the <br />following Finding of Fact pursuant to IC 36-7-4-918.5: <br /> <br /> 1. The approval will not be injurious to the public health, safety, morals, and general <br />welfare of the community for the following reasons: it is consistent with the area and <br />location of the building for proper advertisement. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance <br />will not be affected in a substantially adverse manner; for the reasons that: it is consistent <br />with other uses in the area and should have no affect. <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance will result in practical <br />difficulties in the use of the property. However, the Zoning Ordinance may establish a <br />stricter standard than the "practical difficulties" standard prescribed by this subdivision.
