permitted and all other requirement to the ordinance has been met. The church has met
all requirements The Church fells that the building will be an improvement to this
property and general area and will meet the criteria of the Special Exception.

Mr. Ross Hoilowy, representing Bob and Sherry Stewart, 745 Indianapolis Road who
were unable to attend, presented a letter outlining their concern over the Special
Exception. They are concerned over the health of the community and feel the Scott's
should be required to show proof in the form of a site design or other acceptable evidence
of adequate provisions for utilities, drainage and ingress/egress to Indianapolis Road
should be provided. Mr. Stewart does not believe sanitary sewers currently service the
property and he doesn't believe the soil is acceptable for a septic system. He is
concerned about the traffic coming out on Indianapolis Road with all the other churches
in the area. They are not saying the church is not an appropriate use for this area, but the
board should investigate further points 1,4, and 5 of the Special Exception before
allowing the special exception. They feel there should be some proof of ingress/egress is
adequate for the anticipated growth. Mr. Kramer asked where Mr. Stewart lived and Mr.
Holloway stated is property was immediately north and adjoins the Scott's property. Mr.
Swisher asked is currently all residents on the east side of road were on septic systems
and Mr. Hollowy said be believed they were.

Mr. Peden in response to Mr. Stewarts concerns stated that the chumh could not build
until all these concerns were resolved and had met all the criteria of the zoning
ordinances have been met. They are asking for approval to get started on the process by
getting the Special Exception. They feel the church use of the septic system would be
about the same as a single family dwelling for is will only be in use a few hours a week
Mr. Kramer stated to make a motion the Findings of Fact for a Special Exceptions needed
to be determined.

Findings of Fact

1. The establishment, maintenance or operation of the Special Exception will not
be detrimental or injurious to health, safety, moral or general welfare; No
Concem.
2. The Special Exception will not be injurious to the use and enjoyment to other
properties in the immediate vicinity for the purposes already permitted: No
Concern

The establishment of the Special Exception will not impede or substantially
alter the normal and orderly development of surrounding property for uses
permitted in the district: No Concern

Adequate utilities, access roads, drainage and other necessary facilities have
been or are being provided: A1 long as all building codes are met there are no
problems.
