~%l Prol'essiona p Professional Engineers Land Surveyers February 14, 2002 Town of Mooresville Board of Zoning Appeals Town Hall Mooresville, IN 46158 Re: Objection to special exception; Lenared and Barbara Scott and New Hope Full Gospel Tabernacle Members of the Board: This letter is a formal objection to the special exception application of Lenard and Barbara Scott for the use of approximately three acres at 697 Indianapolis Road, Mboresville for a proposed church. Under Chapter 5, Special Exception Procedures of the Town of Mooresville Zoning Ordinance you must have an affirmative finding on six listed items before a special exception can be granted. We believe that before the Board grants this special exception proof in the form of a site design or other acceptable evidence of adequate provisions for utilities, drainage and ingress/egress to indianapolis Road should be provided. Further we believe evidence must be presented to show how wastewater will be treated. It is our opinion that the soils are not suitable for an on-site wastewater treatment facility (see attachment) and therefore the Town of Mooresville must be willing to provide sanitary sewer service. Until such time that Mooresville has accepted the applicant for sanitary sewer service and applicant is willing to provide the necessary sanitary sewer extension, and has addressed storm water drainage and that ingress/egress to the site is adequate, this application should be denied. In the absence of this evidence, it is our opinion that there can be no affirmative finding for Items 1, 4 and 5 of Subsection B of Chapter 5. Sincerely, p,~Ss Holloway, P.E., P.L.S.
