MOORESVILLE BOARD OF ZONING APPEALS <br />MINUTES <br /> THURSDAY, APRIL 11, 2002 <br /> <br />The Board of Zoning Appeals mot on Thursday, April 11, 2002 at 7:30 P.M. at the <br />Mooresvilt¢ Town FaflL <br />The n~nbers present were: Alan Kramer, Chairman, Jon Swisher, Mike Young, Don <br />Ban'y, and Chris Crouch. Town Altomey, Tim Currens, was present. <br />Motion was made by Don Barry, second by Mike Young to approve the mintr~s ofth~ <br />March 14, 2002 nmafing MotioneaniedS-0. <br /> Next on the agenda was Ross Holloway of Holloway & Associates, representing Mr. Jack <br /> Ward, requesting a Special Exception to allow automobile sales and associuted uses in B- <br /> 3 zoned district. Mr, Holloway statiul they had the properoj rezoned from B-2 ~o B-3 a <br /> months ago; the Town Council approved the rezone in March This Board sent tl~ <br /> few · · ' ' 's effect oftbe <br /> Special Exception to the Plaa Commission for recommendation on it <br /> Master Plan. Ibe Commission staled they found no ill effect of the Masl~ Plan and was <br /> not a hindranoe, so they s6,rt if back to the Board of Zoning for their approval. They <br /> previously turned in their illegal notic~ and gr~ea cards and lvtr. Hotloway was h~ ~o <br /> answer any question the board might have. They do no! believe there will be any <br /> hindran~ lo ~ value, it will not be a health or w~lfere issue, the~ should not be <br /> any advers~ effact on traffic, or other infrastructures. Mr. Currens stated for the tin, rd <br /> thut 11~ pubtic heming for the last meo'in~g was continued with the advice that anYime <br /> present no new notices would be sent out and as he reculls there was no one ~. Mr. <br /> Holloway pointed out thai there have been car sales on Indiana Street for several years. <br /> Mr. Youn$ said be had talked with Mr. Ward about the number of cars they would have <br /> onth¢ lot ut onelim*. Mr. Wardindicattxlthat hi,- wouldunty have about thre* (3)Imm at <br /> a lime. Mr. Young recommended that a limit of six (6) cam be sot for the Special <br /> Exl:eption. Mr. Holloway said Mr. Ward would agr~ to a limilalion of six (6) to eight <br /> (8) oars being set. Mr. Crouch asked if the Sp~ial Ex~ptiun went with the sale of the <br /> propetay andMr. Curtens said that it did. <br /> Mr. Kramer said if there were no further question he would ~ the Fac~s of Findings: <br /> <br /> 1. The establishment or operation of a Special Ex¢option will not be detrimental <br /> to or entinnger the public lmalth, safety, morals or general welfare. No <br /> problem. <br /> 2. The Special EXCelXiun will no~ be injurious ~o the use and enjoyment of~ <br /> other properties in the immediale vicinity for the purposes already permitted. <br /> No problem. <br /> 3. The establishment of the Spooial Exception will not impede or substantially <br /> alter the orderly development and improvemenl of the surrounding lXopeny <br /> for such use as permitted in this district.
