BOARD OF ZONING APPEALS MINUTES <br />THURSDAY, JANUARY 8, 2004 <br /> <br />The Board of Zoning Appeals met on Thursday, January 8, 2004 at 6:00 P.M. at the Mooresville <br />Town Hall. <br /> <br />Members present were Chairman Alan Kramer, Don Barry, Chris Crouch, and Jon Swisher. <br />Mike Young was absent. Tim Currens, Town Attorney, was present. <br /> <br />Motion to approve the minutes for the December 11, 2003 meeting was made by Chris Crouch, <br />second by Jon Swisher. Motion carried 4-0. <br /> <br />Next on the agenda Karen Harman, 440 Maple Lane requesting a variance of use to operate a <br />Therapeutic Massage Practice in her home. Mr. Kramer asked if she had read all the <br />requirements needed to operate the business. She said she had, Mr. Crouch asked how many <br />people she thought she would have and what was the type of therapeutic work would she be <br />doing. She said she had a small clientele, if her~ business increases, she would be working <br />Monday thru Friday from 9:00 AM to 5:00 PM and on Saturday from 9:00AM to 12:00 PM. She <br />only has one customer at a time, so there should not be a parking problem. She might have two <br />cars in her drive if someone comes early for an appointment. She d~e,s mostly Swedish massage <br /> .... ~; t: 4-'~ ' <br />for relaxanon, deep ussue work for someone who is having ~°a~c pr~C61en~s, and she does some <br />seated massage. Mr. Kramer asked if she was planning on having signs to advertise her <br />business. She said the sign would be on the side of her garage or at the end of the drive. Mr. <br />Kramer said there are requirements on the size of sign she can use. She asked if she needed to <br />come to the Clerk's office to find out that information and Mr. Kramer said she was. Mr. <br />Swisher asked if there were any other businesses around her home. She said there was a dog <br />grooming business across the street and on the comer was a hair styling salon. Mr. Crouch asked <br />if she had a room designated for this use and she said the room she would be using was right off <br />the front entryway and it has a door that locks if the customer wants privacy. Mr. Kramer read a <br />letter from Donald and Elizabeth Mansfield stating that they were against the zoning request. <br /> <br />After the reading of the facts-of-finding Mr. Kramer asked for a motion to approve or deny the <br />request for variance of use. Mr. Crouch said the committee for updating the Comprehensive <br />Plan and they have set a line just north of Moomsville Radiator Shop that north of there would be <br />designated as residential. The new plan has been approved by the Plan Commission and has <br />been sent to the Town Council for their approval. The Council will hear this at their next <br />meeting on January 20, 2004. <br /> <br />Motion was made by Chris Crouch, second by Don Barry, to table the request for variance of use <br />until February 12, 2004 until the Town Council has time to look at the new Comprehensive Plan. <br />Motion carried 4-0. <br /> <br />Mrs. Harman is to come back to the February 12th meeting and she does not have to mail out new <br />notices. <br /> <br /> <br />
