MOORESVILLE BOARD OF ZONING APPEALS <br />MINUTES <br /> THURSDAY, FEBRUARY 12, 2004 <br /> <br />The Mooresville Board of Zoning Appeals met on Thursday, February 12, 2003 at 6:00 P.M. at <br />the Mooresville Town Hall. <br /> <br />Board members present were: Chairman, Alan Kramer, Christopher Crouch, Jon Swisher and <br />Don Barry. Mike Young was absent. Town attorney, Tim Currens was absent. <br /> <br />Motion to approve minutes of the January 8' 2004 meeting, as amended, was made by Don Barry, <br />second by Christopher Crouch. Motion carded 4-0. <br /> <br />The first item on the agenda was the petition to operate a used car dealership at 10033 Old State <br />Road 67 by Millard David. Motion to table the petition, because the paper did not get the <br />publication in the paper, was made by Don Barry, second by Christopher Crouch. Motion <br />carried 4-0. <br /> <br />Next was the petition for variance to operate a Therapeutic Massage Practice at 440 Maple Lane <br />by Karen Harman, which was tabled on January 8th meeting. Mr. Barry asked if she would like <br />to table her petition until the March 11th meeting since the Town Board have not approve the <br />new Comprehensive Plan. Mrs. Harman said that was alright. <br /> <br />A motion to table the petition for a variance to operate a Therapeutic Massage Practice until <br />March 11, 2004, per Mrs. Harman's request, was made by Don Barry, second by Jon Swisher. <br />Motion carded 4-0. Mrs. Harmon does not have to mail new notices. <br /> <br />Next was the petition for a variance of use to operate a Bed & Breakfast at 10302 N. Pennington <br />Road by Karen Overpeck. Karen Overpeck, 11310 N. Pennington Road, stated she lived <br />adjacent to this property and she has been renting it. She is fired of having people evicted and <br />having them tear up the house. There is not a Bed & Breakfast in Mooresville. The property is <br />half mile from St. Francis Hospital and people having procedures and family there need a place <br />to stay. She thought this is something she would like to try. She said the house was in the <br />middle of a thirty-acre field, she is the closest neighbor and she is three hundred feet away. Mr. <br />Crouch asked if she had drawings and she said they were in the file. She said it was the second <br />drive off of State Road 144 and set way offthe road. He asked how big was the home and she <br />said it was a three bedroom built in 1950. He asked if it had a private driveway and she said it <br />was one driveway shared by both properties. Mr. Bamj asked how she planned to advertise the <br />Bed & Breakfast and she said she would post a notice at St. Francis Mooresville if she can and <br />by word of mouth. He said the reason he was asking was, because there is sign ordinance and <br />with the state highway there are set backs to be followed. She said she knew that and she needed <br />to know what they were. Mr. Kramer said the state highway could not control anything that was <br /> <br /> <br />
