MOORESVILLE BOARD OF ZONING APPEALS
FINDINGS OF FACT
SPECIAL EXCEPTION

The Town of Mooresville, pursuant to the petition for
Special Exception to all a church in a B-2 District filed by
Cedar Run, Ltd. was heard at the meeting of August 12, 2004 and
the Board proceeded the following Findings of Fact:

1. The establishment, maintenance or operation of the
Special Exception would not be detrimental to or endanger the
public health, safety, morals or general welfare of the community
and that this use is probably less of an impact than the Business
zoning.

2. The Special Exception will not be injurious to the use
and enjoyment of other properties in the immediate vicinity where
the purpose already permitted in that the church usage would
present less of an impact on the neighborhood than the existing
Business zoning.

3. The establishment of the Special Exception will not
impede or substantially alter the normal and orderly development
and improvement of the surrounding property for uses permitted in
the District since most of this property is developed and this
use is compatible.

4. Adequate utilities, access road, drainage and other
necessary facilities have been or are being provided currently.

5. Adequate measures will be made to provide ingress and
egress so designated as to minimize traffic congestion on the
public roads and this will be less of an impact than the Business
use.

6. The Special Exception is located in a District where
such use is permitted and all other requirements in this
Ordinance which are applicable to such Special Exception shall be
met.

Based upon the above Findings, the Mooresville Board of
Zoning Appeals approves the re ed Special Exception this 12th
day of August, 2004.

Donald

t:Z/let<vv /~~~

Alan Kramer
