There <br />will not be a lot of truck traffic on the south side. <br /> <br />Mr. Kramer asked Mr. Holloway to show the audience the drawing to show how the water will <br />not drain onto their property. Mr. Holloway said the existing swale is not very good and they <br />will be defining the swale, piping it through parts of the areas, making sure they have enough <br />inlets to take care of any flow that comes toward their property and before it goes to their <br />property. They can guarantee that there will not be any water ftom their property on to their <br />property and anything coming ftom their property flows toward this site will be collected and <br />carried away. <br /> <br />Mr. Holloway said the variance for 24 hour operation was to clarify the language ofthe <br />Ordinance to allow 24 hour operation in 1-2 use. <br /> <br />Mr. Kramer asked that if in the future with Phase II and they build the road to the south could <br />they prohibit the use of the road except for emergency and give a time when it could be used. . <br />Mr. Holloway said they would rather not do that. Next he asked about the rail cars being kicked <br />around at night and the noise that it would create would not be contained by a sound bearer. Mr. <br />Holloway said that this was discussed at the Plan Commission and they do not believe that they <br />will be handling railcars much at night. Once they are there they will actually do the switching <br />themselves and they do not plan to do that at night. Their game plan for the second and third <br />shifts are to have only intemal operations, however they cannot control when Indiana Southern <br />will run the trains or when the trucks will come in. The trucks may come in late at night and <br />wait until docks open in the morning. <br /> <br />Mr. Kramer asked if the fence could be installed on the inside of the landscape mound and Mr. <br />Holloway said they could do that. They would put a gate in the fence to allow them to get to the <br />mound for maintenance. <br /> <br />After reading the facts-of-finding from Developmental Standards a motion was made by Don <br />Barry, second by Mike Young, to approve the variance for twenty- four hour operation. Motion <br />carried 5-0. <br /> <br />After reading the facts-of-finding ftom Development Standards to approve the variance for <br />buffer setback ftom 100 feet to 70 feet with the stipulation the variance is for the south side of <br />the parcel was made by Charles McGuire, second by Don Barry.
