<br />PLAN COMMISSION MINUTES <br />driveways onto Bethel Road. They are asking for one drive for lot six onto Bethel Road. Lot <br />12 being one of the largest lots a second access help with traffic flow for employees. They <br />would agree to a change in zoning to allow only warehouses and terminals and only on the <br />larger parcels. The Commission was concerned about the extra traffic with more access to <br />Bethel Road, the original feeling was that the only access was to be Hansel Parkway. Mr. <br />Beikman brought up his concerns about the buffer and hazardous material used or stored on the <br />lots with 1-3 zoning. They agree to put on plat the stipulation of hazardous material in a <br />language that would be acceptable with Mr. Beikman and Mr. Currens. A motion was made by <br />Commissioner McGuire and seconded by Commissioner Bennett to allow the rezone of lot <br />twenty-one (21) and twenty-two from PUD-C to PUD-I. Motion carried 7-0. A motion on the <br />plat approval was made by commissioner McGuire and seoonded by Commissioner Ehrhart to <br />allow the twenty-four (24) hour operation, the 1-3 to allow only warehousing and produce <br />terminals and a list of hazardous materials which will be supplied by a oommittee made up of <br />our Building Inspector and the Town Council, lot six (6) would only be I-I, approve the hundred <br />(100) foot setback for all the lots in the park, approve a thirty (30) foot building setback on all <br />lots in the park, lot five (5) have a fifty (50) foot setback on the east side, there will be no access <br />to lot twelve (12) off of Bethel Road, and that lot six (6) will have access to Bethel Road, <br />Motion carried 7-0. <br /> <br />Next was the Special Exception for Hopkins Gravel Pit on Highway 67 south sent to the <br />Commission by the Board of Zoning Appeals. Chairman Beebe read aloud page 67 from the <br />Ordinance Book the requirement for the Special Exception. Mr. Holloway representing Hopkins <br />Gravel, asked for a Special Exception for the flood plain, which is one of the zoning categories <br />of the Mooresville Ordinance, specifically to determine if the area affects the Master Use Plan. <br />The Master Plan shows the area to be the flood plain and the adjoining area towards State Road <br />67 to be zoned B-3. They are asking the area be rezoned to 1-2 for the use of mining of gravel <br />and mineral extraction. For the record they would like to show that mining gravel and mineral <br />extraction will have no effect, but will enhance the flow of the water in the White Lick Creek, <br />providing there is no stock piling of material will improve the operation of the flood plain. <br />Therefore they feel the business in a appropriate use for this area and is in fact in character with <br />Master Plan. Mr Currens inteljected Mr. Holloway, saying he had received a letter from Mr. <br />O'Neal stating he was unable to be present and requested notice of any hearing that may be <br />presented. Mr. Holloway withdrew all comments he just made. Chairman Beebe read aloud <br />page 23 from the Comprehensive Plan Policy 1 and on page 30 District E. South 67 Corridor so <br />that they would be able to make a fair decision of the above matter. A motion was made by <br />Commissioner McGuire and seconded by Commissioner Young to send the Special Exception <br />back to the Board of Zoning Appeals with the recommendation the it does not conform with the <br />Master Use Plan ofMooresville in as according to page 30 and 31 of the Comprehensive Plan <br />that the east side of State Road 67 would be limited to the extent of industrial development <br />because of the buffering required and the residential development already in place. Motion <br />carried 7-0. <br /> <br />Next was the Fields-Conduitt LLC preliminary plat approval at Bridge Street and State Road 67. <br />'- Mr. Jeff Banning of Banning Engineering presented the preliminary plat for Fields-Conduitt LLC <br />
