Mr. Coffey asked the Plan Commission to recommend to the Town Council to deny this <br />rezone. He also questioned if this application was the same one before the Commission prior, <br />therefore being illegal. Ross Holloway explained this was in no way the same application. The <br />rezone requested in the first application was for B-3 and significant changes had been made in <br />the Lot configuration. Commissioner Abbott asked the petitioners if they could give the nature <br />of B-2 use. Ross Holloway said most can have on four acres is a 10,000 square foot building or <br />2-5,000 square foot buildings. <br /> <br />Sue Hull from Forest Dake Subdivision read letter of problems to rezoning to B-2. She said the <br />Car Lot currently on Highway 144 is in violation of several laws right now. She also stated there <br />were 30 - 50 residential homes between Five Points and the property owned by Roberts. Motion <br />was made by Commissioner McGuire, second by Commissioner Ehrhart to recommend to the <br />Town Council to deny the rezone from Agriculture to B-2. The vote was 4-2 with I abstention. <br />Commissioners Pygman and Beebe were opposed. Commissioner Kimmel abstained. This was <br />not a majority vote. Next, motion was made by Commissioner Abbott to recommend to the <br />Town Council to rezone from Agriculture to B-2. No second was forthcoming so the motion <br />died. Motion was made by Commissioner McGuire, second by Commissioner Abbott to table <br />this until the December meeting of the Plan Commission. Motion carried 7-0. <br /> <br />Town Attorney Tim Currens presented the Commission with a copy of The Economic <br />Development Commission's Industrial Revenue Bond recommendation which allows for a lower <br />interest rate on a loan--this is not backed by the Town ofMooresville, no default comes back on <br />the Town. This is for Viking Power Tools and Jack Elrod Co. The Economic Development <br />Commission voted 3-0 in favor of this. Motion was made by Commissioner Abbott, second by <br />Commissioner McGuire to state the Plan Commission finds nothing adverse to the Business <br />Climate of Mooresville. Motion carried 7-0. <br /> <br />Commissioner McGuire presented an update to zoning ordinances from committee and gave out <br />a list to review(see attached list). Commissioner's Ehrhart and Young are putting together a <br />report on POOs. Each member is to present a list for the next meeting, then they will put them <br />together and report to the Town Council in 2 to 3 months. <br /> <br />President Beebe read a letter of complaint concerning Iacoli Car Lot, their zoning and sign. <br />Town attorney Tim Currens stated zoning was Industrial and this was an allowable use. The <br />signs were on the State Highway's right of way and a letter should be sent to the DOT. The <br />Little Bit More Gift Shop does have two cars for sale but they were parked in the State Right of <br />Way. Town Attorney Tims Currens will write a letter to the complaintees. <br /> <br />Ross Holloway wanted to make the Commission aware there was an incident on November 10, <br />1998 for overflow at the trailer park owned by R J Associates. A call was made to IDEM. When <br />they responded they found vandalism but it did not endanger or jeopordize quality of water. R J <br />Associates is installing alarms for Security. Attached is the report from IDEM. <br /> <br />Building Inspector Joe Beikman gave the Commission his list for changes in the zoning <br />
