<br />'- <br /> <br />STIPULATION <br /> <br /> <br />RE: VARIANCE <br /> <br /> <br />WHEREAS, the undersigned, are the owners of certain real <br /> <br /> <br />estate in Morgan County, Indiana, commonly known as 1062 Keller <br /> <br /> <br />Hill Road, Mooresville, In 46158 consisting of 7.469 acres. <br /> <br /> <br />WHEREAS, there is a minor plat sought for said parcel <br /> <br /> <br />dividing the same into two lots. <br /> <br /> <br />WHEREAS, there is also a request for variance pending <br /> <br /> <br />before the Mooresville Board of Zoning Appeals, seeking variance <br /> <br /> <br />with regard to the configuration of Lot No. 2 in said minor plat. <br /> <br /> <br />WHEREAS, at an earlier date, the Mooresville Board of <br /> <br /> <br />Zoning Appeals approved a variance for the purpose of maintaining <br /> <br /> <br />two dwellings upon one parcel, which if approved in the minor plat, <br /> <br /> <br />would be Lot No.1. <br /> <br /> <br />BE IT THEREFORE STIPULATED as follows: <br /> <br /> <br />1. That should the minor plat and variance which is <br /> <br /> <br />currently pending be approved, it is the intent of the undersigned <br /> <br /> <br />to surrender their variance for the additional residence upon Lot <br /> <br /> <br />1, such that there would be only one dwelling upon Lot 1. <br /> <br /> <br />2. That all use of the dwelling for which variance has <br /> <br /> <br />been granted would be discontinued upon either the sale of the <br /> <br /> <br />primary house and dwelling upon Lot 1 or upon the request for <br /> <br /> <br />issuance of a building permit on Lot 2 in said minor plat, whichever <br /> <br /> <br />may occur first. <br /> <br /> <br />3.
