~

MOORESVILLE PLAN COMMISSION
FINDINGS OF FACT

The Mooresville Plan Commission heard the petition for

approval of a Planned unit Development-Residential filed by Swinney

Brothers Excavating, Inc. concerning Collett Acres at it's regular

scheduled meeting of February 24, 1994; and a public hearing having

been held pursuant to notice on the same date.

The Mooresville

Plan Commission now enters it's written findings of fact pursuant

to chapter 6 (Planned unit Developments) of it's Zoning Ordinance,

which are as follows:

1. The Board now finds that the proposed Planned unit

Development is consistent with the Comprehensive Plan and intent of

the Zoning Ordinance due to the hybrid of lot sizes and minimum

'-

house sizes all of which create a harmonious variety of residential

uses creating an attractive, healthful, efficient, and stable

environment for living with all of the proper streets, sidewalks,

and utilities.

2. That the Board finds that the Planned unit Development

encourages an innovative use of the land and lot sizes through the

restrictive covenants requiring larger home sizes on smaller lots

while providing all of the proper utilities, open spaces and type

of overall design that would enhance the quality of life for the

residents of this community.

3. The Plan Commission finds that this Planned unit

Development-R is an effective use of the land with the size of lots

----

provided, requirement of a multiple number of residential homes
