<br />~ <br /> <br />MOORESVILLE PLAN COMMISSION <br />FINDINGS OF FACT <br /> <br />The Mooresville Plan Commission heard the petition for <br /> <br />approval of a Planned unit Development-Residential filed by Swinney <br /> <br />Brothers Excavating, Inc. concerning Collett Acres at it's regular <br /> <br />scheduled meeting of February 24, 1994; and a public hearing having <br /> <br />been held pursuant to notice on the same date. <br /> <br />The Mooresville <br /> <br />Plan Commission now enters it's written findings of fact pursuant <br /> <br />to chapter 6 (Planned unit Developments) of it's Zoning Ordinance, <br /> <br />which are as follows: <br /> <br />1. The Board now finds that the proposed Planned unit <br /> <br />Development is consistent with the Comprehensive Plan and intent of <br /> <br />the Zoning Ordinance due to the hybrid of lot sizes and minimum <br /> <br />'- <br /> <br />house sizes all of which create a harmonious variety of residential <br /> <br />uses creating an attractive, healthful, efficient, and stable <br /> <br />environment for living with all of the proper streets, sidewalks, <br /> <br />and utilities. <br /> <br />2. That the Board finds that the Planned unit Development <br /> <br />encourages an innovative use of the land and lot sizes through the <br /> <br />restrictive covenants requiring larger home sizes on smaller lots <br /> <br />while providing all of the proper utilities, open spaces and type <br /> <br />of overall design that would enhance the quality of life for the <br /> <br />residents of this community. <br /> <br />3. The Plan Commission finds that this Planned unit <br /> <br />Development-R is an effective use of the land with the size of lots <br /> <br />---- <br /> <br />provided, requirement of a multiple number of residential homes <br />
