MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br />SOUTHBRIDGE CROSSING SPECIAL EXCEPTION ON LOT 4D <br /> <br /> A special exception having been filed on Lot 4D at Southbridge Crossing for <br />placement of an automobile repair shop (Big O Auto Tire Store) in a B-3 zoned area by <br />special exception; <br /> <br /> The Mooresville Plan Commission having made a finding and report to the Board of <br />Zoning Appeals that the proposed location and character of the special exception will not <br />affect the Master Land Use Plan; <br /> <br /> The Board of Zoning Appeals having heard evidence at a public hearing the 16th day <br />of September, 1998 finds the following: <br /> <br /> 1. The establishment, maintenance or operation of the special exception will not be <br />detrimental to or endanger the public health, safety, morals or general welfare of the area in <br />which the special exception will be operated. <br /> <br /> 2. The special exception will not be injurious to the use and enjoyment of other <br />properties in the immediate vicinity for the purpose already permitted. <br /> <br /> 3. The establishment of the special exception will not impede or substantially alter <br />the normal and orderly development and improvement of surrounding property for uses <br />permitted in the district and should have no effect on the area and development of it. <br /> <br /> 4. Adequate utilities, access roads, drainage and other necessary facilities have been <br />or are being provided as shown on the Plat of the subdivision. <br /> <br /> 5. Adequate measures have been taken to provide ingress and egress so designated as <br />to minimize traffic congestion on the public roads surrounding the special exception. <br /> <br /> 6. The special exception will be located in a district whereby such use is permitted <br />and all other requirements in this Ordinance which are applicable to such special exception <br />will be met. <br /> <br />V~rn Kimmel <br /> <br /> <br />
