Motion carried 5-1, Commissioner Pygman opposed. <br /> <br />Next on the agenda, 0 & R Properties, 436 East Carlisle, request for rezone from R-l to R-2, <br />tabled from November meeting. Bob Stewart told the commission a variance had been obtained <br />for an 1800 square foot building on this lot. He reminded that at last meeting they said they <br />would decrease the size to 1000 square feet with parking in front and back if they needed for this <br />rezone request to be approved. Motion was made by Commissioner Bennett, second by <br />Commissioner Ehrhart to recommend to the Town Council to approve rezone from R-l to R-2. <br />Motion carried 5-1. Commissioner Pygman opposed. <br /> <br />Paul Claire,C P Morgan, the Commons at Heartland Crossing presented third and final section <br />for approval of Plat. The Preliminary Plat was approved in August 1999 and he did not <br />understand why this final plat approval was voted down in the November meeting. There are <br />112 lots in 20.28 acres. Motion was made by Commissioner Bennett, second by Commissioner <br />Young to approve the plat. Motion carried 6-0. <br /> <br />Ross Holloway presented a request for approval for a 4 Lot Minor Plat on the east and west side <br />of Overpeck Road owned by Mary and Kenneth Hill. They own forty four acres. Mr. Sarber is <br />buying 21.06 acres west and Mr. Eganoff is buying 23.5 acres east. They will share common <br />utility and access with $200 annual maintenance fee. Covenants and restrictions are the same for <br />both plats. Minumun home size of 1800 square feet, two story homes must have 1500 square <br />feet on the ground with a total of2600 square feet, log homes are permissable or 50% brick and <br />will be on septic. A county highway permit for access onto Overpeck road has been obtained. <br />Setback of 40 feet. Smallest lot is two acres, some are five acres and some are eight acres. <br />Sheryl Cromwich told the commission she wants a validation of where her property line is. She <br />told the commission the county hadn't corrected the survey. Mr. Holloway told her he has filed <br />a corrected survey with the county and it had been recorded. Alan Kinnett, owner of property on <br />west side asked commission if at some point these lots could be made smaller, or if the <br />covenants and restrictions could be changed at some point to say the property could be divided <br />more. Town attorney Tim Currens told Mr. Kinnett they can be amended if owners come back <br />to the Plan Commission, but covenants and rest rictions weigh heavily with the Plan <br />Commission Board. Tom Wilkins, 475 Bunker Hill Road, told the commission he was not <br />informed of this meeting by mail. His concern was Lot 1 and Lot 2 on the Sarber side would <br />drain about 60 feet north of his house. He said one-third of this plat drains to this point. His <br />concern was would there be any change in the water shed or runoff? Mr. Holloway told him he <br />thought run-off would be less with development than with agriculture. Motion was made by <br />Commissioner Pygman, second by Commissioner Young to approve west side portion of minor <br />plat owned by Sarber. Motion carried 6-0. Motion was made by Commissioner Young, second <br />by Commissioner Bruner to approve east side of minor plat owned by Eganhoff. Motion carried <br />6-0. <br />
