<br />-2- <br /> <br />.,.,- <br /> <br />building standing which had not been damaged severely by the fire. He also advised <br /> <br />that there was debris piled from the original structure which needed to be removed. <br /> <br />Mr. Harper advised that he could not afford to haul off the debris and the insurance <br /> <br />carrier had not honored the claim to date. He advised that he would need approximately <br /> <br />60 days on this matter. William Abbott then made a recommendation that the parties <br /> <br />be granted 60 days to finish the clean-up and that the Board continue the hearing <br /> <br />until the April, 1987 meeting. <br /> <br />The Board then proceeded to the next matter on the agenda, that being <br /> <br />the complaint regarding zoning violations at 39 West Main Street, Mooresville, Indiana, <br /> <br />the property owned by Douglas Turner. Mr. Turner was present along with his tenants. <br /> <br />1he Board's Attorney advised that the alleged violations consisted of carrying on <br /> <br />a business use which is not permitted in the area as zoned, the woodcutting business. <br /> <br />In addition that the property was zoned General Business which would not allow the <br /> <br />property to be used for a residential use. Thirdly, that there was a problem with <br /> <br />the automobile business being conducted on the property, however, if the property <br /> <br />is properly zoned General Business this is acceptable use. Mr. Turner spoke to the <br /> <br />issues and advised that when he purchased the property, approximately 10 years ago, <br /> <br />it was being used as a single family residence and later as a double. He wanted to <br /> <br />know whether or not the use for residential purposes had been grandfathered in. <br /> <br />The Board's Attorney advised that he would have to meet with him and see the dates <br /> <br />to see the effect on the new ordinance. The Board unanimously agreed that the <br /> <br />woddcutting business should not continue and the parties present likewise agreed <br /> <br />to comply with the Board's reques t. <br /> <br />The next item to come before the Board was the preliminary plat of George <br /> <br />Fox. The Board reviewed the plat as presented and advised Mr. Fox that it was not <br /> <br />in compliance with the ordinance requirements for preliminary plat. The Board showed <br /> <br />him what additional information would be needed and requested that he come back <br /> <br />at the next meeting to present this. <br />
