MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br /> <br /> The Board having received an application for special exception for power line <br />transmission lines by Hoosier Energy REC, Inc. extending from Southbridge Crossing north <br />on SR 67 across SR 144 at its intersection with SR 67. The Board having received notice <br />from the Plan Commission that the proposed special exception will not affect the Master <br />Land Use Plan now proceeds to the following Finding of Fact: <br /> <br /> 1. The establishment, maintenance or operation of the special exception will not be <br />detrimental to or endanger the public health, safety, morals, and general welfare of the <br />community. <br /> <br /> 2. The special exception will not be injurious to the use and enjoyment of other <br />parties in the immediate vicinity for the purposes already permitted. <br /> <br /> 3. The establishment of the special exception will not impede or substantially alter <br />the normal and orderly development and improvement of the surrounding property for the <br />uses permitted in the district. <br /> <br /> 4. Adequate utilities, access roads, drainage and other necessary facilities have been <br />or are being provided. <br /> <br /> 5. Adequate measures have been or will be taken to provide ingress and egress so <br />designed as to minimize traffic congestion on the public roads. <br /> <br /> 6. The special exception will be located in a district where such use is permitted and <br />is permitted and other requirements in this Ordinance which are applicable to the special <br />exception will be met. <br /> <br />APPROVED this 19th day of Aug~uust~, 19~8~ <br /> <br /> Donald <br /> <br /> Alan K~mer <br /> <br />Michael Young <br /> <br /> <br />
