MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br />FOR VARIANCE FROM DEVELOPMENT STANDARDS <br /> <br /> Pursuant to IC 36-7-4-918.5 the Mooresville Board of Zoning Appeals having heard <br />the variance filed by Charles O'Neal of 267 E. Main St., Lot 8, Block 16, Moore Second <br />Addition, Mooresville, Indiana, requesting a variance from development standards as <br />follows: area of Lot 1 square feet from 10,000 to 4,985 and area of LOt 2 square feet from <br />21,780 to 6,319; the Board now makes the following Finding of Fact pursuant to IC 36-7-4- <br />918.5: <br /> <br /> 1. The approval will not be injurious to the public health, safety, morals, and general <br />welfare of the community in that other parking is available. <br /> <br /> 2. The use and value of the area adjacent to the property included in the variance <br />will not be affected in a substantially adverse manner due to adjoining uses. <br /> <br /> 3. The strict application of the terms of the Zoning Ordinance will result in practical <br />difficulties in the use of the property. However, the Zoning Ordinance may establish a <br />stricter standard than the "practical difficulties" standard prescribed by this subdivision.
