<br />---- <br /> <br />'--' <br /> <br />FINDINGS OF FACTS AND JUDGMENT <br /> <br />Comes now the Mooresville Plan Commission and having heard the <br /> <br />stipulation of j1ldgment entered into by the Building Inspecto~ Joseph Beikman, <br /> <br />~n e~forcement authority for the Town of Mooresville under its Unsafe Building <br /> <br />'--- <br /> <br />Ordinance, and the property owner, Jerry K. Graybill, regarding the noti~e of <br /> <br />order pursuant to the Civil Town of Mooresville's Ordinance Number 15, 1982, an <br /> <br />ordinancp providing for the inspection, repair, or removal of unsafe buildings <br /> <br />within the Civil TO'ffi of Moeresville. The Board now finds the following: <br /> <br />1. T~at the property located at 129 East High Street, Mooresvillc, <br /> <br />Indiana is an unsafe building as defined in O~dinan~e Number 15, 1982 and all <br /> <br />amendments thereto apd in particular under paragraph 6 of said o~dinance s~b-sections <br /> <br />(c) the structu~e has water damage to studs and top plates, (e) the front of <br /> <br />the structure is not properly secured, (f) the foundation is settled and deter5.or2teè <br /> <br />to the point that 30 to 45 percent of it is not secure, (g) sub-sections 2 and 4 <br /> <br />the sections replaced do not comply with minimum code requirements) (i) the front <br /> <br />,:all does net comply to ordinance standards, (k) items 1 and 2 (1) the previo~s <br /> <br />construction does not meet code requirements pursuant to the work done under permit <br /> <br />number 1170 issued March 4, 1985, (m) sections 1,2 and 3 (n) the~e a~e no sanitation <br /> <br />facilities, (0) item J - there is a lack of sufficier.t fire resistant materials <br /> <br />and there is faulty ele~trical wiring. Based upon this there is a finding that <br /> <br />said struct~re is an unsafe building and i.n addition that both the Building <br /> <br />Iaspector M~. Beikman and the property o~~er, Jerry K. Graybill, have stip~lated <br /> <br />to this finding. The Board fu~ther finds that the parties stipulate to a judgment <br /> <br />whereby Jerry K. Graybill shall be given 60 days to have the property located at <br /> <br />129 East High Street, Mooresville, Indian3 ready for the issuance of an occupancy <br /> <br />permit with all violations being brought up to code and cured in full, in the <br /> <br />event said work is not timely completed to these specifications at the end of <br /> <br />60 days from October 23, 1986 the Town shall proceed with a demolition of said <br />
