<br />, <br /> <br />Page 2 <br /> <br />the petition in order. There were no third parties appearing <br />either in favor of or against the request. Upon motion duly <br />made by Mr. Steve Edwards, seconded by Mr. George Smith, and <br />unanimously passed by all members present, the rezoning classifi- <br />cation of the property shall be recommended to the Mooresville <br />Town Board to general business, subject, however, to finalization <br />of the annexation procedures as provided by statute. <br /> <br />Mr. Steve Beagle, of 234 North Meridian Street, Greenwood, <br />Indiana, telephone number 888-8642, appeared before the Board <br />and advised the Board that he was purchasing on contract the <br />building commonly known as the 'IOld Kindrick Hospital". <br /> <br />Mr. Beagle was informed of the variance which had been given to <br />Mr. Heath at the time he appeared before the Board of Zoning <br />Appeals several years ago. Mr. Beagle was also advised of the <br />problems that the Board had experienced in the use of this <br />property and informed Mr. Beagle that at this point in time the <br />only proper use of this building was for apartments on the second <br />floor with business buildings on the lower. If he wished to change <br />this procedure, he would have to ask for a further variance in the <br />use of the property or to request rezoning. <br /> <br />Mr. George Smith indicated that he had made inquiry with the <br />Indiana Fire Marshall's office and that a letter had been sent <br />to the property owner indicating that smoke detectors would have <br />to be installed in the apartment building to comply with State <br />requirements. Mr. Beagle said he was aware of this and was in <br />the process of complying with this procedure. Mr. Smith also <br />advised Mr. Beagle that he had been in contact with the Adminis- <br />trative Building Counsel and there was no record that any approval <br />had been given for the use of this property for apartment dwellings <br />by the present owner and the contract seller, Mr. Heath. Mr. <br />Beagle was directed to contact the Administrative Building Counsel <br />to comply with whatever requests would be made by this adminis- <br />trative agency. <br /> <br />Mr. Beagle advised the Board as to improvements that he intended <br />to make on the property. He also indicated that he had proceeded <br />to discuss the problem areas as alleged by the neighboring property. <br /> <br />The Board thanked Mr. Beagle for appearing before it. <br /> <br />The Committee which had been asked to make inquiry in regards to <br />the James Rippy property at 66 Sweetwood Drive, Mooresville, <br />Indiana 46158, reported that it appeared that a business was being <br />operated or had been operated there in the past.
