<br />-- <br /> <br />'- <br /> <br />MOORESVILLE PLAN COMMISSION <br /> <br />The Mooresville Plan Commission met in regular session at <br />7:30 P.M., on May 26, 1977. Members present were Vice President, <br />William Abbott, serving in the absence of the President, Steve <br />Edwards, Lewis Truax, Tilford Bailey and Eweather Stephens. Also <br />present was David E. Lawson, .ttorney for the board. <br /> <br />Minutes of the previous meeting were approved as read. <br /> <br />Attorney Lawson examined legal documents relating to the <br />business to be considered and found them in order. <br /> <br />Docket #1, 1977, was presented by Steve Harris, Attorney for <br />co-petitioners Paul & Louise Swisher and William F. and Vivian Kirby. <br />Petitioners were seeking a re-zoning for property located at 257 <br />N. Monroe Street from Residential A-Single family to Local Business, <br />which would allow for construction of a 30ft. X 40 ft, profession.l <br />building ~NX~NX on the front ~. the property, but leaving the <br />present rental structure (single family residence) on the back part <br />of the lot. <br />how <br />Remonstrators speaking to ~N.I such a re-zoning would affect <br />adjoining properties of Taggart Woods were, Robert Myers. Bill <br />Overholser and Charles Landon, all residents of Taggart Woods. <br /> <br />Having leBrd lengthy evidence from both petitioners and <br />remonstrators, a motion was made by Lewis Truax to grant re-zoning <br />of the front part of the lot with the exception of seventy five (7') <br />feet off the east end of the property, which would remain residential <br />A-Single family. The motion was seconded by Tilford Bailey. <br /> <br />The vote was: <br />Voting yes - William Abbott, Lewis Truax and Tilford Bailey <br /> <br />Voting No - Steve Edwards, Eweather Stephens <br /> <br />Any proposal requires a vote of four (4) for enact~n,tJ th~~fore <br />the petition for re-zoning to Local business was 8eRie~4~~~' <br /> <br />Attorney Lawson was asked to check out complaints about the <br />Ron Magenheimer property located at 644 Nelson Dr. A pole barn type <br />structure measuring 23 1/2' X 34 1/2' has been constructed on the <br />property and complaints Indicate its intended use Is of a commercial <br />nature. Attorney Lawson was instructed to issue a letter of protest <br />to the property owners who are in violation of zoning codes for the area. <br /> <br />The Plan commission heard a report of the Buffer Zone Progress. <br /> <br />Current zoning maps are to be updated from Aug. 1974 forward by Town <br />Engineer, William Abbott. Once maps are updated the Buffer Zone can <br />better be defined. Attorney Lawson is to check at Martinsvllle to <br />determine what the present County Zoning Is in the Mooresville Area. <br />When these things have been accomplished the Mooresville Plan Commission <br />will make recommendations to the Town Board which will in turn hold <br />a public hearing to amend the Master Plan. <br />
