MOORESVILLE BOARD OF ZONING APPEALS <br /> FINDINGS OF FACT <br />HOPKINS SPECIAL EXCEPTION FOR SAND AND GRAVEL MINING OPERATION <br /> <br /> The Mooresville Board of Zoning Appeals having heard the special exception request <br />filed by Jeremy Hopkins for a sand and gravel mining operation at its meeting held May 20, <br />1998 now makes the following Finding of Fact pursuant to Chapter 5 of the Mooresville Zoning <br />Ordinance: <br /> <br /> 1. The establishment, maintenance, or operation of the special exception, sand and <br />gravel mining operation/would be detrimental to and endanger the public health, safety, morals, <br />and general welfare of/the community due to the truck traffic that it would bring into the area <br />and the nature of the existing roads. <br /> <br /> 2. The special exception would be injurious to the use and enjoyment of other properties <br />in the immediate vicinity for the purposes already permitted which include residential use and <br />the cemetery. <br /> <br /> 3. The establishment of the special exception will not impede or substantially alter the <br />normal and orderly development and improvement of surrounding property for uses permitted <br />in those districts. <br /> <br /> 4. Adequate utilities, drainage and other necessary facilities have been or are being <br />provided including the interior access roads, however, the exterior access roads are not adequate. <br /> <br /> 5. Adequate measures have been or would be taken to provide ingress and egress so <br />designed as to minimize traffic congestion on the public roads internally, however, the external <br />controls for trucks and other consumers cannot be controlled and would not be adequate on the <br />existing roads. <br /> <br /> 6. The special exception would be located in a district where such use is permitted and <br />all other requirements in the Ordinance which are applicable to such special exception would be <br />met. <br /> <br /> Based upon the information received at the public hearing and a review of the special <br />exception the Mooresville Board of Zoning Appeals deny the special exception request. <br /> <br /> <br />
